<br /> Carol Mittlesteadt, attorney for Rosalie Davies, owner of record of the subject property, <br /> advised that her client had been cooperative, but was upset over two occurrences: Mrs. <br /> Davies was not notified of the meeting until Saturday, September 24, 1994, and neither <br /> had had enough time to review the materials; additionally, Mrs. Davies had not given <br /> permission for anyone to do any soils testing on her property. Ms. Mittlesteadt advised <br /> that while Mrs. Davies had been busy with litigation with Mr. Davies over post trial <br /> motions, her good tenant had been negotiated away. Ms. Mittlesteadt stated that as a <br /> consequence of the soils testing there now existed an adverse contamination report, and <br /> those two factors, the report and the loss of tenants, greatly affected the value of the <br /> property. Ms. Mittlesteadt advised that Mr. Al Davies has the opportunity to appeal the <br /> ownership decision by October 12, 1994, and she would have to advise Mrs. Davies not to <br /> make any decisions or improvements regarding the property until the final ownership <br /> decision had been made. Ms. Mittlesteadt asked the Council why it was pushing forward <br /> with this Specific Plan when Mrs. Davies hands were tied. <br /> Joe Steinfeld, candidate for Council, stated that two gentlemen had come into his store <br /> and separately said they had been interested in property in Redwood City, but they were no <br /> longer interested because of redevelopment policies. Mr. Steinfeld stated that the City was <br /> in hock due to Sequoia Station, and that auto dealerships should find their own way to the <br /> freeway. Mr. Steinfeld stated that the City should not interfere between two private <br /> parties, such as Mr. Irmer and Mrs. Davies. Mr. Steinfeld stated "I would like to know <br /> how much money we intend to bribe Mr. Irmer with this time..." <br /> Mayor Buchan told Mr. Steinfeld that was enough and to sit down. <br /> Mayor Buchan reminded everyone that the Public hearing on this issue had been held and <br /> closed, but the Council could hear other speakers if they so wished. <br /> Mr. Al Davies asked to address the Council. Councilman Greenalch told Mr. Davies <br /> that the proposed Specific Plan provides more flexibility to the owner of that property, <br /> asked Mr. Davies if he had had an opportunity to review the Plan and asked him what he <br /> would like the Council to hear. Mr. Davies stated he had read the plan and the people of <br /> Redwood City were being taken advantage of by the power of the Redevelopment Agency <br /> - by taking property from the rightful owners. Councilman Greenalch asked Mr. Davies if <br /> he understood that a Specific Plan did nothing to the people who owned the property - it <br /> was simply a way of saying what the Council would like to see on that site if the owner <br /> changed its use, and that the Plan included three recommendations. Mr. Davies provided a <br /> summary of redevelopment and Safeway activities regarding that property, and stated that <br /> an environment had been created whereby the leaseholders had a difficult time keeping <br /> employees and the Agency did not leave enough property to keep adequate inventory. <br /> Vice Mayor Claire advised that the proposed Specific Plan had nothing to do with <br /> condemnation nor taking of any property, but only established what the Council would <br /> like to see on that property if the owner changed the current use.
