38 <br /> <br />17.2.7 This grievance procedure shall be the sole and exclusive procedure for <br />processing objections or challenges to punitive disciplinary actions and <br />shall satisfy all administrative appeal rights and protections afforded <br />by the Public Safety Officers Procedural Bill of Rights Act, Government <br />Code Sections 3300, et seq. <br /> <br />17.3 Procedure <br /> <br />Grievances will be processed in accordance with the following procedures: <br /> <br />17.3.1 Level I - Informal Resolution <br /> <br />17.3.1.1 Any unit member who believes he/she has a grievance <br />which is an alleged violation of the specific provisions of <br />this MOU shall present the grievance orally to the <br />immediate supervisor within ten (10) calendar days after <br />the grievant knew, or reasonably should have known, of the <br />circumstances which form the basis for the grievance. <br />Failure to do so will render the grievance null and void. <br />The immediate supervisor shall hold discussions and <br />attempt to resolve the matter within ten (10) calendar <br />days after the presentation of the grievance. It is the <br />intent of this informal meeting that at least one personal <br />conference be held between the aggrieved employee and <br />the immediate supervisor. <br /> <br />17.3.1.2 Any unit member who believes he/she has a grievance <br />which is an objection or challenge to any punitive <br />disciplinary action shall present the grievance orally to the <br />Captain within ten (10) days after the grievant knew, or <br />reasonably should have known, of the circumstances which <br />form the basis for the grievance. Failure to do so will <br />render the grievance null and void. The Captain shall hold <br />discussions and attempt to resolve the matter within ten <br />(10) days after the presentation of the grievance. It is the <br />intent of this informal meeting that at least one personal <br />conference be held between the aggrieved employee and <br />the Captain. <br /> <br />17.3.2 Level II - Formal Written Grievance <br /> <br />17.3.2.1 If the grievance is not settled during the informal <br />conference and the grievant wishes to press the matter, <br />the grievant shall present the grievance in writing on the <br />appropriate form to the Chief of Police within ten (10) <br />calendar days after the oral decision by the immediate <br />supervisor. The written information shall include: (a) A <br />description of the specific grounds of the grievance, <br />including names, dates, and places necessary for a <br />complete understanding of the grievance; (b) A listing of <br />6.1.C. - Page 49
