19 <br /> <br /> <br />9.2 Industrial Disability Leave <br /> <br />Any safety employee as defined by the MOU between the City and the Public <br />Employees' Retirement System, who has suffered a disability arising out of and <br />in the course of his or her employment, as defined by Workers' Compensation <br />Laws of the State of California, shall be entitled to industrial disability leave <br />while so disabled without loss of salary, for the period of such disability to a <br />maximum of one (1) year or until the condition is permanent and stationary or <br />until retirement, whichever occurs first. During the period the employee is <br />paid by the City, the employee shall assign or endorse to the City any benefit <br />payments received as a result of Workers' Compensation Insurance coverage. <br /> <br />The City reserves the right to withhold payment of any disability benefits until <br />such time as it is determined whether or not the illness or injury is covered by <br />Workers' Compensation. <br /> <br />A safety employee on industrial disability leave shall accrue sick leave and <br />vacation in accordance with the Workers' Compensation laws of the State of <br />California. <br /> <br />Employees in the classification of Police Officer Trainee who suffer any <br />disability arising out of and in the course of their employment, as defined by <br />the Workers' Compensation Laws of the State of California, shall be entitled to <br />industrial disability leave while so disabled for the period of such disability to a <br />maximum of one (1) year or retirement, whichever occurs first. Compensation <br />benefits shall be determined and paid in accordance with the Workers' <br />Compensation Laws of the State of California. <br /> <br />Employees in the classification of Police Officer Trainee shall not accrue sick <br />leave or vacation leave benefits during any period of disability. <br /> <br />In the event that the City exercises its right to withhold immediate payment of <br />industrial disability benefits, and until such time that a coverage determination <br /> <br />is made, employees may elect to utilize accrued sick leave for the interim <br />period. If accrued sick leave becomes exhausted, workers may then elect to <br />utilize accrued vacation leave or accrued compensatory leave for any <br />remaining interim time. <br /> <br />9.3 Military Leave <br /> <br />Military leave shall be granted by the City in accordance with the provisions of <br />State and Federal laws and there may be a deduction for any military <br />compensation that the employee receives for service during the period that he <br />is receiving full pay from the City, if permitted by law. All employees taking <br />military leave shall give the City an opportunity, within the limits of military <br />regulations, to determine when such military leave shall be taken. <br /> <br /> <br />6.1.C. - Page 30
