Page 1 of 4 <br />ATTY/RESO.0016/CC RESO LAGOON SPRAYING MND <br />REV: 02-11-16 VR <br />Resolution No. 2016-_______ <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OR REDWOOD CITY <br />ADOPTING THE MITIGATED NEGATIVE DECLARATION AND MITIGATION <br />MONITORING AND REPORTING PROGRAM FOR THE USE OF COPPER TO <br />CONTROL ALGAE AND AQUATIC VEGETATION IN REDWOOD SHORES LAGOON <br />ALL IN ACCORDANCE WITH THE REQUIREMENTS OF THE ENVIRONMENTAL <br />QUALITY ACT <br />WHEREAS, The State Water Resources Control Board released a Statewide General <br />National Pollutant Discharge Elimination System (NPDES) Permit for the Discharge of Aquatic <br />Pesticides for Aquatic Weed Control in Waters of the United States (Permit), and the City of <br />Redwood City (“City”) has obtained coverage under this Permit to apply aquatic pesticides to the <br />Redwood Shores Lagoon; and <br />WHEREAS, The City desires to use aquatic algaecides and/or aquatic herbicides containing <br />copper on an “as needed” basis to more efficiently control algae and/or aquatic vegetation in the <br />Redwood Shores Lagoon. The Policy for Implementation of Toxics Standards for Inland Surface <br />Waters, Enclosed Bays, and Estuaries in California, also known as the State Implementation Plan <br />(“SIP”) assigns effluent limitations for California Toxics Rule priority pollutants, including <br />algaecides or aquatic herbicides that contain copper. The SIP also prohibits discharges of priority <br />pollutants such as copper in excess of applicable water quality criteria; and <br />WHEREAS, Although the SIP prohibits the discharge of copper in excess of applicable water <br />quality criteria into receiving waters, Section 5.3 of the SIP allows for short-term or seasonal <br />exceptions if determined to be necessary to implement control measures for resource or pest <br />management (i.e., algae or aquatic vegetation control) conducted by public entities. The City has <br />determined that it meets the criteria for gaining a Section 5.3 SIP exception for the use of copper <br />to control algae and aquatic vegetation in the Redwood Shores Lagoon; and <br /> WHEREAS, Pursuant to this exception and as part of the City’s Integrated Pest <br />Management (“IPM”) program, the City proposes to apply aquatic algaecides and/or aquatic <br />herbicides containing copper on an as needed basis to control algae and/or aquatic vegetation, <br />when determined to be the most effective treatment measure, in the Redwood Shores Lagoon <br />(the “Project”). Control of this vegetation is necessary in order to maintain the aesthetic quality, <br />aquatic habitat, and recreation within the area. Vegetation control is also necessary so that the <br />Lagoon can reasonably serve as a stormwater retention basin and provide urban flood protection <br />by storing surface runoff during high tide periods in San Francisco Bay; and <br /> WHEREAS, Pursuant to the California Environmental Quality Act (Public Resources Code <br />Section 21000 et seq.; hereafter, “CEQA”) and the Guidelines for Implementation of the California <br />Environmental Quality Act (Title 14, Sections 15000 et seq. of the California Code of Regulations; <br />hereafter, the “CEQA Guidelines”), the City prepared an Initial Study and Mitigated Negative <br />Declaration for the Project dated October 15, 2015; and <br /> <br />6.3.A. - Page 5
