Public Hearing - Council to consider a request to vacate a portion of Cedar Street pursuant <br /> to Part 3 of Division 9, California Streets and Highways Code (702-06) <br /> Affidavits of publication and posting are on file in the City Clerk Department <br /> REPORT: City Engineer, December 14, 1994 <br /> Staff recommendation: continue the Public Hearing scheduled for December 19, 1994, <br /> to 7:30 P.M., or as soon thereafter as possible, on January 30, 1995,401 Marshall, <br /> Redwood City, to allow time for the Peninsula Conflict Resolution Center (PCRC) to <br /> provide assistance with a property owner dispute. <br /> Mayor Gasparini explained the staff recommendation for all the parties to meet with the <br /> PCRC to see if they can work out a solution among themselves. Mayor Gasparini advised <br /> there were three speaker's cards submitted, but the Council could hear them without <br /> opening the Public hearing. <br /> MIS: Hartnett/Steinfeld that the Council hear the speakers but advise them that the <br /> Council did intend to refer this matter to PCRC without debate; and this matter would be <br /> reconsidered on January 30, 1995, with the hope that the matter had been resolved by the <br /> parties involved at that time. <br /> In response to Councilwoman Steinfeld's question, City Attorney Schricker advised that <br /> the motion was preliminary, that the Council was dealing with property interests and the <br /> individuals mayor may not have an interest or ownership interest in the property, and they <br /> may have some compelling reason why they do not want the public hearing to be <br /> continued, and they were entitled to have the Council hear their concerns. If their <br /> comments were on the merits there was no sense in having two hearings, and if there were <br /> no objections to referring the matter to the PCRC, well and good. If there was an <br /> objection, the Council should hear and make a determination as to whether the hearing <br /> should be continued. There will have to be a public hearing at some point as it is a matter <br /> of vacating a street.
