7.B. - Page 116 <br /> Mitigation Monitoring and Reporting Plan <br /> or other actions determined during consultation,is allowed if it is the only feasible treatment <br /> method. <br /> Responsible Party: City of Redwood City <br /> Mitigation Measure CULT 3: Stop Work if Buried Paleontological Deposits are Exposed <br /> during Ground-Disturbing Construction <br /> If ground-disturbing activities expose buried paleontological resources,work shall stop within a <br /> 50-foot radius of the find until a qualified paleontologist has identified and evaluated the significance <br /> of the find and,if necessary,developed a Treatment Plan in consultation with the City and Caltrans, <br /> if found within the Caltrans right-of-way. <br /> Responsible Party: City of Redwood City <br /> Mitigation Measure CULT 4: Notification of Human Remains Exposed During <br /> Construction <br /> If construction activities expose human skeletal remains,ground-disturbing activities shall stop with <br /> a 50-foot radius of the discovery, and the City and the Contractor shall comply with CEQA Section <br /> 15064.5 (e),including the following: <br /> • Redwood City shall immediately notify the County Coroner; <br /> • If the County Coroner determines that the human remains are Native American, the City <br /> shall notify the Native American Heritage Commission (NAHC),who will appoint a <br /> Most Likely Descendant (MLD) pursuant to Public Resources Code (PRC) Section <br /> 5097.98); <br /> • The City,the MLD, and archaeological consultant shall make all reasonable efforts to <br /> develop an agreement for the treatment,with appropriate dignity, of human remains and <br /> associated or unassociated funerary objects,pursuant to CEQA Guidelines Section <br /> 15064.5(d), taking into consideration the appropriate excavation,removal,recordation, <br /> analysis, custodianship, curation,and final disposition of the human remains and <br /> associated or unassociated funerary objects; <br /> • If the NAHC-appointed MLD, Caltrans,and the City cannot reach an agreement within <br /> 48 hours, the landowner or his or her representative shall rebury the Native American <br /> remains on a site where no further subsurface disturbance would occur; <br /> • Ground-disturbing activities may resume after the County Coroner and the appropriate <br /> law enforcement authority have released the area for construction. <br /> Responsible Party: City of Redwood City <br /> July 15,2013 A-5 US 101 Pedestrian Undercrossing and <br /> Bair Island Storm Water Pump Station Project <br />
