WHEREAS, at the February 10, 2016 public hearing, pursuant to Section 2.0.3- <br /> A-1-a on page 26 of the DTPP, the Zoning Administrator considered and accepted <br /> the recommendation of the AAC regarding the Project's proposed deviations from the <br /> guidelines of the DTPP; and <br /> WHEREAS, after closing the February 10, 2016 public hearing, the Zoning <br /> Administrator determined that the proposed Downtown Planned Community Permit <br /> including three guideline deviations, and Parking In-Lieu Fee would further the purposes <br /> of and appropriately implement the City of Redwood City General Plan, applicable <br /> provisions of the Downtown Precise Plan, and the 2075 Broadway Project, and <br /> approved the Project; and <br /> WHEREAS, on February 17, 2016, the Zoning Administrator issued a Notice of <br /> Official Action (NOA) approving the Project with the three guideline deviations and <br /> Parking In-Lieu Fee and documenting the analysis, findings and conditions for approval <br /> of the Planned Community Permit and Parking In-Lieu Fee Application; and <br /> WHEREAS, an appeal of the Zoning Administrator's approval was filed with the <br /> City during the 15-day appeal period by Mr. Kris Johnson (Appellant), challenging the <br /> Zoning Administrator's approval of the Project; and <br /> WHEREAS, the matter was duly noticed for a de novo public hearing before the <br /> Planning Commission on April 19, 2016; and <br /> WHEREAS, on April 19, 2016, the Planning Commission conducted a duly <br /> noticed de novo public hearing in accordance with all applicable requirements of the <br /> Redwood City Municipal Code, all applicable requirements of the State Planning <br /> and Zoning Law, the City Zoning Ordinance and the Downtown Precise Plan, to <br /> consider the appeal of the Project, and received and considered oral and documentary <br /> evidence on the appeal and application (including updated traffic analyses — a Traffic <br /> Impact Analysis dated March 29, 2016 and a Peak Hour Traffic Data Comparison report <br /> dated March 21, 2016 — which support the conclusions of the Initial Study that there are <br /> no new significant traffic impacts or increases in severity of any previously identified <br /> significant traffic impacts); and <br /> WHEREAS, the Planning Commission considered the Initial Study checklist <br /> prepared by the City's Planning Division and its findings, the updated traffic analyses <br /> referenced above, the previously certified Downtown Precise Plan Program EIR (State <br /> Clearinghouse #2006052027), and the entire record of the administrative <br /> proceedings regarding the adoption of the Downtown Precise Plan (including <br /> ATTY/RESO.0027/PC RESO 2075 BROADWAY <br /> REV:04-18-16 VR <br /> Page 2 of 28 <br />
