without limitation the Mitigation, Monitoring and Reporting Plan attached to <br /> Resolution No. 15086 adopted on January 24, 2011); and <br /> WHEREAS, the Planning Commission determined that the proposed <br /> Downtown Planned Community Permit including three guideline deviations, and the <br /> Parking In-Lieu Fee would further the purposes of and appropriately implement the <br /> City of Redwood City General Plan and the Downtown Precise Plan. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION <br /> OF THE CITY OF REDWOOD CITY AS FOLLOWS: <br /> Section1. The Planning Commission, having independently heard, considered <br /> and weighed all the evidence in the record, including evidence presented by City staff, <br /> the Applicant, the Appellant and members of the public, and being fully informed of the <br /> Project, the Zoning Administrator's decision, and the appeal, finds that the Appellant <br /> has not shown, based on evidence in the record, that the Zoning Administrator's <br /> decision was made in error, that there was an abuse of discretion by the Zoning <br /> Administrator, that the Zoning Administrator's decision was otherwise improper, or that <br /> the City's notices, agendas, and appeal procedures were unlawful in any manner, and, <br /> in the exercise of its independent judgment, hereby denies the appeal and approves the <br /> Downtown Planned Community Permit including three guideline deviations, and the <br /> Parking In-Lieu Fee based on the following findings and subject to the Conditions of <br /> Approval set forth below. This determination is based on the entire record, including <br /> without limitation the application materials, the DTPP, 2011 DTPP EIR, the entire record <br /> of the administrative proceedings regarding the adoption of the DTPP, the staff reports <br /> and attachments prepared for the Zoning Administrator hearing on the Project and the <br /> appeal, each of which is incorporated herein by reference and which serve as an <br /> adequate and appropriate evidentiary basis for the findings and actions set forth in this <br /> Resolution. <br /> Section 2. Initial Study Checklist (IS): In the exercise of its independent <br /> judgment, the Planning Commission finds that: <br /> a. The IS was prepared in accordance with all legal requirements. <br /> b. The Planning Commission has reviewed and analyzed the IS and <br /> other information in the entire record (including the updated traffic <br /> analyses referenced above) and has considered the information <br /> contained therein, including the written and oral comments received <br /> at the public hearing on the Project, prior to acting upon or <br /> approving the Project. <br /> c.
