<br /> ARTICLE II <br /> BENEFITS <br /> 2.1 Retirement Benefits. <br /> The Retirement Benefit commencing pursuant to Section 1.2 shall be paid in the Normal <br /> Form of Benefit and in an amount determined by the Plan Administrator as set forth in Schedule <br /> A with respect to each Eligible Employee. The benefit may be subject to an annual cost of living <br /> adjustment as determined by the Employer at the time of separation. <br /> 2.2 Desi2nation of Beneficiarv. <br /> <br /> (a) Each Member shall have the right to designate a Beneficiary to receive the death <br /> benefits, if any, that are payable to a Beneficiary from this Plan. Such designation does not <br /> permit the Member to change a person identified under another provision of the Plan as being <br /> eligible to receive a benefit. Such designation must be evidenced by a written instrument filed <br /> with the Employer, on a form prescribed by the Employer, and signed by the Member. <br /> (b) The Beneficiary for a married Member shall be the Member's spouse at the date of <br /> death, unless the written consent of such spouse is provided upon a form acceptable to the <br /> Employer. Each such designation for death benefits must be evidenced by a written instrument <br /> filed with the Employer, on a form prescribed by the Employer, and signed by the Member. If <br /> no such designation is on file with the Employer at the time of the death of the Member, or if for <br /> any reason at the sole discretion of the Employer, such designation is defective, then the spouse <br /> of such Member shall be conclusively deemed to be the Beneficiary designated to receive such <br /> benefit. <br /> -3- <br /> NB I :508358.9 <br /> ", .--........."......'.... <br />
