<br />o Educate entity regarding Redwood City's reporting requirements to prevent recurring <br />deficiencies in future years. <br /> <br />Audit Services - Phase 2 of Project <br /> <br />Audit Services are designed to identify entities subject to taxation by the City of Redwood City <br />that are not properly reporting the full amount of tax to which they are subject to under the City's <br />ordinances. Audit Services identify entities who are potentially underreporting, or not reporting <br />all applicable taxes, and MMC reviews the entity's records to ensure compliance with Redwood <br />City's taxes. In performing the Audit Services, MMC shall: <br /> <br />o Establish a comprehensive inventory of the registered entities subject to taxation by <br />Redwood City and the database elements needed to facilitate an analysis of records of <br />those entity's current and prior years tax remittance; <br /> <br />o Compare MMC records with Redwood City records to identify potential under-reporting <br />entities subject to taxation; <br /> <br />o Meet with designated Redwood City staff to review and discuss potential audit candidates <br />and to determine which entities will be subject to review. Only entities mutually agreed by <br />MMC and City to be reviewed shall be subject to MMC's audit services; <br /> <br />o For potential under-reporting entities identified, obtain authorization from Redwood City to <br />conduct a review of the entities' records and determine the amount of tax due for current <br />and prior periods (plus applicable interest and penalties, where appropriate); <br /> <br />o Submit audit summaries to Redwood City to permit Redwood City to determine the amount <br />of a deficiency owed, if any (MMC will calculate as part of the summary the amount we <br />determine that is owed, but this step allows the City discretion in pursuing the deficiencies); <br /> <br />o Invoice entity for the amount of identified deficiencies, together with supporting <br />documentation therefore, and remit payment received to Redwood City; <br /> <br />o If the City elects to have MMC conduct payment deposit services, applications will be <br />forwarded with copies of the payments and payments deposited into an account designated <br />by the City; <br /> <br />o Educate entity regarding Redwood City's reporting requirements to prevent recurring <br />deficiencies in future years; <br /> <br />TIMING AND REPORTING <br /> <br />MMC shall commence project planning within 10 working days following authorization. <br />Annually, MMC shall provide Redwood City with a report summarizing Tax Compliance service <br />progress to date. <br /> <br />MMC shall deliver the initial set of the Tax Compliance Service reports within forty-five (45) days <br />following authorization and receipt of data necessary to conduct the work. Redwood City and <br />MMC will mutually agree on the frequency and type of periodically updated Tax Compliance <br />Service reports to be provided thereafter. <br /> <br />COMPENSATION <br /> <br />Discovery Services <br /> <br />MMC's Compensation for providing Discovery Services shall be a contingency fee of 45% of the <br />additional revenue realized by Redwood City from the services. The 45% shall apply to the <br />current year's assessment, all eligible prior period revenues, and any applicable penalties, <br />interest, and fees. Said 45% will not apply to any waived penalties and interest. The fee only <br />applies to revenue actually received by Redwood City. <br />
