6.3.C. - Page 12 <br /> EXHIBIT A <br /> TERMS AND CONDITIONS <br /> 1. City Hours of Operation. The time set forth in this Section for use of the Parking <br /> Structure and the Parking Lot by the public are, for the purposes of this Agreement, the <br /> "City Hours of Operation." The City Hours of Operation shall be: <br /> a. Every Friday commencing at 4:00 p.m. and ending each Monday at 2:00 <br /> a.m., except when County holidays fall on a Monday. For each County holiday <br /> that is on a Monday, City Hours of Operation shall include such holiday, and shall <br /> end at 2:00 a.m. on Tuesday. A list of the County holidays is attached to the <br /> Agreement as Exhibit B and incorporated herein by reference. The list of County <br /> holidays may be amended from time to time by County provided City receives <br /> said amended list at least thirty days prior to implementation; and <br /> b. Every Monday through Thursday from 6:30 p.m. to 2:00 a.m. of the <br /> following day. <br /> With written approval of the County Manager, the City Hours of Operation may be <br /> increased provided that such additional City use does not interfere with County use of <br /> the Parking Structure and Parking Lot. <br /> 2. Number of Parking Spaces. The Parking Structure contains approximately six <br /> hundred forty-six (646) spaces located on levels one (1) through five (5); the Parking Lot <br /> contains approximately one hundred fifty-one (151) at-grade spaces (collectively, the <br /> "Parking Spaces"). County cannot guarantee the availability to City of all of the Parking <br /> Spaces. Any unused spaces shall, pursuant to the terms of this Agreement, be made <br /> available to the City for use by the general public during the City Hours of Operation. <br /> The parties also understand and agree that during the term of this Agreement, the <br /> County may elect to construct a new structure or structures in the area presently <br /> occupied by the Parking Lot and that, in such an event, Parking Spaces presently in the <br /> Parking Lot will become unavailable for use by the County and the City. Nothing in this <br /> Agreement shall limit the County's discretion to undertake such construction and, in the <br /> event that such construction takes place, the County and City will confer in good faith <br /> regarding any appropriate changes to this Agreement. <br /> 3. Reservation of Parking Stalls for Office of the Sheriff. The County shall have <br /> exclusive use of three (3) on-street parking stalls on Bradford Street at the entrance to <br /> the Brendan McGuire Facility for use by the Office of the Sheriff.
