ASSISTANT CITY ATTORNEY II <br /> DEFINITION <br /> 2/ 9/ 77 <br /> Under direction , to assist the City Attorney in all phases of <br /> City legal work involving a wide variety of technical and legal <br /> assignments . All work is performed in close cooperation with the <br /> City Attorney and is subject to his review and final decision . <br /> DISTINGUISHING CHARACTERISTICS OF THE CLASS <br /> The incumbent in this class performs legal work peculiar to <br /> municipal government and administration . Assignments are made by <br /> the City Attorney and require general direction by the City Attorney . <br /> The incumbent is expected to exercise considerable independence in <br /> the determination of procedures and points of emphasis in the <br /> performance of assignments which are normally carried through all <br /> research and presentation phases . The incumbent is expected to <br /> exercise secondary responsibility in the office of the City Attorney <br /> and to act for the City Attorney in his absence . The incumbent <br /> is expected to supervise , in the absence of or by direction of the <br /> City Attorney , all other office personnel . <br /> EXAMPLES OF DUTIES AND RESPONSIBILITIES <br /> Prepares and gives legal opinions on all phases of municipal <br /> government ; gives legal advice to City Council and to department <br /> heads and other City officials ; drafts and/or reviews ordinances , <br /> resolutions , proposed charter amendments , petitions , pleadings , <br /> briefs , contracts , leases , deeds , and other legal instruments ; <br /> represents the City and City officials in litigation in which the <br /> City or City officials are either plaintiff or defendant , including <br /> the preparation of summons , petitions , complaints , answers , <br /> interviewing witnesses , research , preparing briefs , negotiating <br /> settlement , appearance in Court and before various boards or <br /> commissions , and handling appeals when necessary ; studies and <br /> interprets the constitution , laws , Court decisions , statutes , <br /> ordinances and other legal authorities to give legal advice or <br /> prepare opinions ; passes on validity of claims against the City <br /> and makes recommendations for allowance or disallowance thereof ; <br /> handles correspondence and holds interviews , telephone conversations , <br /> conferences and negotiations in performing legal duties , attends <br /> meetings of the Council , boards , commissions and committees , when <br /> directed by , or in the absence of , the City Attorney ; advises and <br /> assists in preparing for and conducting elections ; appears before <br /> all Federal and State Courts and administrative agencies ; advises <br /> " EXHIBIT G " <br />
