WHEREAS, on February 16, 2016, the Planning Commission held a public hearing and <br /> received public testimony on the DEIR. The City received written and public testimony from the <br /> public during the DEIR public review period; and <br /> WHEREAS, the City prepared written responses to the comments received during the <br /> comment period and included these responses in the FEIR and prepared a separate document <br /> entitled "Mitigation Monitoring and Reporting Program," which together with the DEIR <br /> constitutes the FEIR; and <br /> WHEREAS, the FEIR was published on April 18, 2016 with a 15-day circulation; and <br /> WHEREAS on May 3, 2016, the Planning Commission held a duly noticed public <br /> hearing on the Final EIR as well as the following Project approvals, (1) Planned Development <br /> Permit Amendment, including setback and parking modifications, (2) Use Permit, (3) <br /> Architectural Permit, and (4) Tentative Map for the construction of a new 2-story 64,000 sq. ft. <br /> high school for Design Tech located at 275 Oracle Parkway. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br /> CITY OF REDWOOD CITY, AS FOLLOWS: <br /> 1. The above recitals are true and correct and together with the staff report and the <br /> application materials, including without limitation the FEIR, tentative map, and all other <br /> documents, reports, studies, memoranda, maps, oral and written testimony, and materials in the <br /> City's file for the applications and the Project, and all adopted City planning documents relating <br /> to the Project and the property including the City's General Plan, Zoning Ordinance, and other <br /> applicable City laws and regulations, and all associated approved and certified environmental <br /> documents, have together served as an adequate and appropriate evidentiary basis for the <br /> findings and actions set forth in this Resolution. <br /> 2. The City of Redwood City is the lead agency under CEQA for preparing the <br /> FEIR, and is the entity with final decision-making authority with regard to approval of the <br /> proposed Oracle Design Tech High School. <br /> 3. The Planning Commission finds that the FEIR for the project was presented to <br /> the Planning Commission, that the FEIR was prepared, published, circulated, reviewed and <br /> completed in full compliance with State law and CEQA Guidelines, that there was adequate <br /> public review of the DEIR, that it has considered all comments on the DEIR and responses to <br /> comments, that the FEIR adequately discusses all significant environmental issues, and that the <br /> FEIR reflects the independent judgment and analysis of the Planning Commission. <br /> 4. The Planning Commission has reviewed and considered the information <br /> contained in the FEIR prior to acting on the proposed Oracle Design Tech High School. <br /> 5. The Planning Commission finds that the information added in the FEIR does not <br /> constitute significant new information requiring recirculation, but rather that additional <br /> information clarifies or amplifies an adequate EIR. <br /> 6. Pursuant to CEQA section 261081 and CEQA Guidelines section 15091 and in <br /> support of its approval of the Project, the Planning Commission has reviewed and considered <br /> the CEQA Findings of Fact for the Project, attached hereto as Exhibit A and incorporated herein <br /> ATTY/RES0.0036/PC RESO CERTIFYING EIR—ORACLE DESIGN TECH HIGH SCHOOL <br /> REV:04-29-16 VR <br /> Page 2 of 31 <br />
