8.B. - Page 19 <br /> In any case where a Variance has not been used within one (1) y ur from the effective date <br /> thereof by the commencement of construction of the improvement or improvements, or by <br /> the initiation of the activity or activities which is or are the subject matter of the Variance, all <br /> rights thereunder shall c se and terminate. <br /> A Variance expires one year from the effective date if permitted construction has not begun <br /> for the related work. As requested by the applicant, the Zoning Administrator may grant a <br /> one-time one-year extension prior to permit expiration. <br /> [ARTICLE 45] <br /> 45.9 - Effectiveness and Expiration. [Architectural Permit] <br /> A. Effective Date. An Architectural Permit is effective upon the expiration of the appeal <br /> period.If an appeal is filed,the Architectural Permit shall not become effective until after the <br /> final decision on appeal. <br /> B. Expiration.An Architectural Permit expires one year from the effective date if <br /> permitted construction has not begun for the related work.As requested by the applicant, <br /> the Zoning Administrator may grant a one-time one-year extension prior to permit <br /> expiration. <br /> [ARTICLE 46] <br /> 46.11 - Expiration. [Planned Development Permits] <br /> In any case where a Planned Development Permit has not been used within one(1)year from <br /> the date of granting by obtaining a building permit and beginning of construction of the <br /> is the subject of the permit, the permit shall automatically terminate and be of no further <br /> effect; provided, however, the Zoning Administrator or the Commission, as the case may be, <br /> may extend this time once for an additional year upon written request of the applicant.
