8.C. - Page 19 <br /> the establishment or operation of marijuana cultivation facilities, and <br /> commercial cannabis activities, as well as medical marijuana deliveries. <br /> COMMISSIONER QUESTIONS <br /> Commissioner Radcliffe asked for clarification on "caregiver." She asked if <br /> the caregiver for a homebound patient can bring a prescription. Ms. <br /> Ramirez stated that under the proposed ordinance, they cannot. Nobody <br /> can deliver medical marijuana to any individuals under the City's <br /> jurisdiction. One alternative is to allow a caregiver to provide those <br /> deliveries to someone who is homebound and has a prescription. <br /> Commissioner Radcliffe asked if the quantity is limited. Ms. Ramirez stated <br /> that the key is that the caregiver can have up to five patients. The City <br /> Attorney's office is recommending prohibition because they do not have <br /> time to establish more thorough legislation. <br /> Commissioner Radcliffe asked if this will be revisited at a later date. Ms. <br /> Ramirez stated that there is a prohibition just to maintain local control. This <br /> will allow the discussion to continue after March 1. <br /> Commissioner Schmidt asked if the cultivating also includes residents on <br /> their property for themselves. Ms. Ramirez stated that currently the <br /> ordinance prohibits any cultivation; however, there is an alternative that <br /> allows personal cultivation not-for-sale. <br /> Commissioner Schmidt asked the Deputy Chief if Redwood City currently <br /> has a significant problem or would have a problem with this prohibition. <br /> Deputy Chief Kirby stated that data in Redwood City can give an idea of the <br /> trend. There have not been the typical negative criminal consequences of <br /> these activities because the Council had passed prohibition so early. There <br /> have been very few cases of individuals cultivating their own grow based on <br /> their patient status that they could grow their own marijuana. The law <br /> states that people can have any quantity as long as it's for personal use. <br /> There is no statistic on how many qualified patients are growing their own <br /> marijuana. There is no demand for service from citizens stating that they <br /> have been burglarized for their personal grow. The other data was the <br /> California chief's study on what is happening in the state and other cities <br /> who have dispensaries but did not have the foresight to limit distributions. <br /> He spoke about the restrictions on transportation that already exist from the <br /> state, and some nuances for discussion in that regard. <br /> Commissioner Hale stated that there are individuals in the community <br /> enjoying benefits under the current law that could potentially be taken away <br /> by this proposal. She stated that it's important to know that there are 3,000 <br /> patients who are being served, particularly those who don't have reliable <br /> transportation. She asked if the proposals are an option for this evening or <br /> if they need to wait until future discussions. Ms. Ramirez stated that they <br /> are an option but Staff has not been able to determine the pros and cons of <br /> each alternative. She stated that the key tonight is that there is legislation <br /> in place in order to maintain local control. <br /> Page 6 of 9 <br />
