The City snd Property Owner agree �at the health, safety snd w�etfare of the <br /> citizens of the Cityr requ�re that the stormwater treatment measure(s� d��ed � the Site <br /> Plan be c�nstruc�ed and maintained on the Property; and <br /> l. The C'�s Stormwater Management Ordinanoe, Storsnwater related <br /> guidelines, c�iteria and other written directions ("C'rty Stormwater Regulations") require that <br /> the stormwater treatment measure(s), as shown on the approved Site Ptan� be oonstructed <br /> and maintained by the Property Owner. <br /> AGREEMENT <br /> NOW, THEREFORE, in consideratEOn of the benef'd r�eceived by the Property Owner <br /> as a resu� of the City's approvai of the Site Plan, the Property Owner hereby covenants <br /> and agrees with the City as foilows: <br /> 1. Construction of Tr�eatment Measures. The on-site Storm�nrater #reatment <br /> measure(s) shown on the Site Ptan shall be c�onstructed by ihe Proper#y Owner tn strict <br /> accordance with #hg approved plans and spec�ffications ident�'ied for the Property and any <br /> other requirements thereto which have been approved by the City� oonfamance arith City <br /> Stormwater Regulatrons. <br /> 2. Oqeration & Maintenance Responsib€lifil. This Agreement shall serve as the <br /> signed statement by the Property Owner accepting responsibility #of opera#ion and <br /> main#enance of stormwater treatment measures as set forth in th�s Agreement until the <br /> responsibility is legally transferred to another person or entity. Before the Property is <br /> legally transferred to another person or entity, the Proper#y Owner shali provide to the <br /> City at least one of the foliowing: <br /> a. Written conditions in the sales or lease agreement requiring the buyer or <br /> lessee to assume responsibility for operation and maintenance (O&!N) consistent with <br /> this provision, which conditions, in the case of purchase and sale agreemen#s, shall be <br /> written to survive beyond the close of escrow; or <br /> b. Written text in project conditions, covenants and restrictions (CC&Rs) for <br /> residential properties assigning 08�M responsibilities to the home owners �ssociation for <br /> 08�M of the treatment measures; or <br /> c.
