3. Maintenance of Treatment Measures. The Property Owner sha#I not destroy or <br /> remove the starmwater treatment measures from the Property nor mod'rfy the stormwater <br /> treatment system in a manner that 1es�ns its effectiveness, and shall, at Property <br /> Owner's sale expense, adequately maintain the stormwater treatment measure(s) in <br /> good working order acceptable to the City and in acoordance with the Site Plan and <br /> Inspection and Maintenance Chscklist. This includes all pipes, ch�rnnels or other <br /> canveyances built to convey stormwater to the treatment measure{s}, as weil as all <br /> structures, �mprovements, and vegetation provided to control the quantity and qu�lity of <br /> the stormwater as set forth in the Site Plan. Adequate maintenance is F�erein de�ned as <br /> maintaining the described facilities in good working condit�on so that these facilities <br /> continue to operate as originaily designed and approved. The In�pection and <br /> Maintenance Checklist shaH inciude a deteil�d description of�nd schedule for long-term <br /> maintenance activtties of tfie stormwater treatment measures. <br /> 4. Sediment Manaqement. Sediment accumulation resu�ing from the normal <br /> operation of the stormwater treatment measure(s) wili be managed appropriately by the <br /> Property Owner. The Property Owmer wiA provide for the removai end ctisposal of <br /> accumulated sedimen#s. Disposal of accumulated sediments shaFl rtot oocur on the <br /> Property. Any disposal or removal of a�mulated sed'tments or debr€s shall be in <br /> oompi�ance with ali federal, state and bcal law and regulations. <br /> 5. Annuat Insaedion and Re�. The Property Owner shall, on an annuai basis, <br /> complete a Treatment Measure Operation and Maintenance Inspec�on Repcxt ("Annual <br /> Repart"). The Annual Repo�t shall indude all comple#ed Inspedic�n end Maintenance <br /> Chedctists for the reporting per�d and shall be submitted to the C�y �n order to verify <br /> that �nspection and maintenance of the applicable stormwater treatm�nt measure(s) <br /> have been conducted pursuant to this Agreement. The Annual Report shatl be submitted <br /> no later than December 31 of each year� under penalty of perjury, to Ofif'�ce of the City <br /> Engineer, 1017 Middlefield Road, Redwood City, CA 94063 or another member of the <br /> City staff as directed by the City. The Property Owner shall prov�fe �n the Annual Report a <br /> record of the volume af all accumulated sediment removed as a result of the treatmsnt <br /> measure(s).The Property Owner shail conduct a minimum of one (1) annual inspection of <br /> the starmwater treatment measure(s) before the wet season. This inspectkm shali occur <br /> between August 1� and October 1 St each year. More frequent �nspections mey be <br /> required. The resutts of inspections shall be recorded on the Annual lnspectian Report. <br /> 6. Nec�ssarv ChanQes and Modifications. At its sole e�cpense, the Property Owner <br /> shall make changes or modifications to the stormwater treatment measure{�) as may be <br /> determined as reasonably necessary by the City to ensure that the starmwater treatment <br /> measures are properly maintained and oontinue to operate as origina�#y designed �nd <br /> approved. <br /> 7. Access #o the ProaertY. The Property Owner hereby grents perm��sion to�e City; <br /> the San Frandsoo Bay Regionai Water Quality Control Board (Reg'bnsi Board}; the �an <br /> Mateo County Mosquito Abatement District (Mosquito Abatemen# Di�trict); and their <br /> authorized agen#s and employees to enter upon the Property at rea�a#� �mes and in a <br /> R�v:ot-��-�s vR <br /> P�e 3 of 7 <br /> A'FTY/AGR.2016.011/RWC ECR Venture,LlC-3TMMA <br />
