7.D. - Page 3 <br /> The Ordinance consists of the following key components: <br /> 1. Establishment of an Art in Public Places Fund. <br /> The proposed Ordinance initially establishes a new Art in Public Places Fund to fund <br /> the provision of public art within the City. Monies from the Fund may be used to fund <br /> publicly accessible art on City Property or on private property where the art to be <br /> installed is funded with City funds or grants procured by the City. Such art must comply <br /> with qualifications set forth in the Ordinance. Such qualifications include guidelines <br /> designed to ensure that funds are used for original works of art rather than functional <br /> structures or mass-produced commodities. The qualifications also set forth guidelines <br /> with respect to placement and size of public art that are designed to ensure that public <br /> art acquired using the Art in Public Places Fund is visible to the public and proportional <br /> to its surroundings. <br /> Art acquired and/or installed using the Art in Public Places Fund will be reviewed by the <br /> Civic Cultural Commission, which will make a recommendation for approval or <br /> disapproval to the City Council. The City Council will have final approval authority for all <br /> art funded by the Art in Public Places Fund. <br /> 2. Contribution of 1% of the Capital Outlay Fund to the Art in Public Places <br /> Fund. <br /> The proposed Ordinance establishes a City policy of setting aside one percent of the <br /> annual Capital Outlay Fund to be contributed to the Art in Public Places Fund. The <br /> Capital Outlay Fund is part of the City's General Fund and is used to fund capital <br /> improvement projects. The primary source of monies in the Capital Outlay Fund is the <br /> Utility Users Tax. <br /> The proposed one percent contribution would be set by City Council during the annual <br /> budgeting process, and the percent to be contributed may be modified from year-to-year <br /> at the discretion of the City Council. Funds contributed to the Art in Public Places Fund <br /> from the Capital Outlay Fund may be used to fund public art pursuant to the approval <br /> procedures set forth in this Ordinance. <br /> The Ordinance provides that any prohibited or restricted funds shall not be used in <br /> calculating the one percent contribution. This will ensure that restricted funds are <br /> excluded from the Art in Public Places Fund. <br /> 3. Public Art for Private Developments. <br /> The proposed ordinance requires certain private commercial development projects to <br /> provide publicly visible art on-site that is equal in value to at least one percent of the <br /> project's construction valuation. Developers may choose to make a contribution to the <br /> Art in Public Places Fund in lieu of placing art on their project site. They may also <br />
