h. Emercencv Service - Contractor shall also respond to emergency calls for <br />service at any and all times day or night every day during the term of this <br />contract within two (2) hours of being notified to provide such service. <br />Emergency service events generally include traffic accident cleanup of <br />debris on the roadways, storm debris clean-up, and mud/debris on the <br />roadway as a result of water main breaks or other work. For emergency <br />service, Contractor shall bill the City on an hourly basis. <br />I. Unscheduled Service — Upon City's request, Contractor shall provide <br />unscheduled sweeping of any street(s) or portion(s) of street(s). The City <br />will give Contractor a minimum twenty-four (24) hour notice for <br />unscheduled sweeping. Contractor shall satisfactorily complete any <br />contingency sweeping within two (2) business days after notification from <br />the City. These sweeping services shall be billed at an hourly rate. The <br />City will only pay for total hours swept, and will not pay for any unused <br />contingency hours. <br />j. Callback - Whenever, in the opinion of the City, a section of street is <br />inadequately swept, the Contractor shall, within 24 hours after notification, <br />re -sweep the section in question and may, at the discretion of the City, <br />forfeit as penalty one hundred dollars ($100) for each time a street is <br />inadequately swept. No additional payment will be made for callbacks as a <br />result of inadequate sweeping. <br />k. Weather - In the event of heavy rain or other severe weather conditions, <br />the scheduled sweeping service may be suspended. The decision to <br />sweep will be made by the City. The Contractor shall contact the Public <br />Works Superintendent or Public Works Supervisor to determine if <br />sweeping has been suspended. <br />I. Water - City will provide Contractor with water necessary for street <br />sweeping. Water may be obtained from the potable hydrant located in the <br />Public Works Corporation Yard. Should the Contractor need to obtain <br />water from additional hydrants within the City, the Contractor must apply <br />for a construction meter at City Hall. The Contractor will be responsible for <br />paying the deposit fee and monthly meter service charges. Contractor <br />must use a City construction meter to fill from a hydrant within the City. <br />III. Equipment <br />The equipment used to complete street sweeping required by this contract is subject to <br />the approval of the City, and Contractor must be in possession of equipment capable of <br />being able to remove a variety of material that can be found on streets (e -g. leaves, <br />glass, gravel, dirt, mud, etc.) <br />REV: 07-25-17 MI <br />ATMAGR.Amend No. 1 /Contract Sweeping Services <br />Page 5 of 34 <br />
