<br /> Louann Johnston, 3015 E. Bayshore Blvd., Harbor Village resident, advised <br /> that when she bought her mobile home in 1989 she was not allowed to assume <br /> existing lease and instead of $220 per month had to pay $350 from day one, <br /> and three years 1 ater she is "paying, $460. <br /> Shelley Riggs, 3015 E. Bayshore Blvd., Harbor Village resident, described <br /> inequitable rent situation in the Park, loss of affordable housing and <br /> minimal service to Park residents. <br /> Mark Moore, 575 San Pedro, Morgan Hill, from the Golden State Mobile Home <br /> Owners League representing the Parks in Redwood City stated the need for an <br /> this ordinance due to Park owners reluctance to negotiate and the on-going <br /> clashes over property rights which will extend into the future. Mr. Moore <br /> described transferable leases but not as a preferred method; described <br /> costs of operation of a mobile home rent stabilization ordinance and <br /> arbitration paid by tenants, owners, City or a combination thereof; age and <br /> conditions of existing parks; asked who will have to pay for repairs; asked <br /> what will happen when the current leases expire; and spoke in favor of net <br /> operating costs concept. <br /> Bruce Stanton, 328 El Pas eo de Saratoga, San Jose, attorney representing <br /> Harbor Village and Golden State Mobile Home Owners League described two sets <br /> of property rights, mobile homes as manufactured housing, and described <br /> Hall, Yee and Sandpiper court rulings on physical or regulatory "taking." <br /> Mr. Stanton suggested Council look at the ordinances in East Palo Alto and <br /> Sonoma County. <br /> In response to Council requests, staff agreed to provide information on <br /> existing leases and how they would be affected by this proposed ordinance. <br /> MEMO 10/27/92 <br /> ------------------------------------------------------------------------------- <br /> Mayor La Berge declared a recess at 10:18 p.m. <br /> Meeting reconvened at 10:29 p.m. <br /> ------------------------------------------------------------------------------- <br /> THE FOLLOWING PEOPLE SPOKE IN OPPOSITION TO THE PROPOSED ORDINANCE: <br /> Paul Deffebach, 307 So. B Street, San Mateo, attorney representing the <br /> Western Mobile Home Association, described the unique nature of the mobile <br /> home industry and posed the questions, where does the value of the home come <br /> from and how is it apportioned over time. Mr. Deffebach provided statistics <br /> on rents, new and resale prices for mobile homes in Redwood City and in <br /> Arizona, and described the shared value which comes from the land. Mr. <br /> Deffebach agreed with Council if the 1985 Agreement between the owners and <br /> residents of Harbor Village was violated the residents should pursue the <br /> matter. Mr. Deffebach advised existing leases would be exempt from the <br /> proposed ordinance, and stated a need for the ordinance has not been <br /> established. Mr. Deffebach advised trailers should not be included in a <br /> mobile home ordinance and advised fees from mobile homes would not be enough <br /> to pay for operation of a mobile home ordinance.
