Improvements include new recycled water and storm services, levee improvements, a
new bay trail including the path and landscaping, new sidewalk, and pedestrian lighting.
The levee structure will be dedicated to the City as part of the Improvement Agreement,
and the Landscape Maintenance Agreement will require the Bay Trail pathway and
landscaping to be maintained by the property owner. The project will also require a
revocable encroachment permit to allow for a private water main and sewer service
across Oracle Parkway, which will be required prior to final acceptance of the project by
City Council. The private services were allowed simply due the isolated parcel not
having nearby public facilities to construct to in a feasible manner, and a deed
restriction will be recorded against the property to ensure that future sale or of the
property will require a public system to be constructed.

The developer, Centrum Owners Association, and Oracle America, Inc, will post bonds
in the amount of $2,190,387.00 as required by the Improvement Agreement. The
developer anticipates completion of all improvements before school operations
commence.. All work associated with this project is being paid for by the developer.

ALTERNATIVES
Council may choose not to approve the parcel map and associated agreements for the
project.

FISCAL IMPACT
There is no fiscal impact to the City as a result of this action.

ENVIRONMENTAL REVIEW
The Planning Commission considered and certified the Environmental Impact Report
prepared by the City’s Planning Department in accordance with the requirements of the
California Environmental Quality Act (CEQA), and based on the approved
Environmental Impact Report and a Mitigation Monitoring and Reporting Program in
compliance with all CEQA requirements, as part of the City’s consideration of Planned
Development Permit Amendment (PDA2015-01), Use Permit (UP2015-13),
Architectural Permit (AP2015-63) and Tentative Map (TM2015-04).

JAMES O’CONNELL, PE
ASSOCIATE ENGINEER

AARON AKNIN, AICP
COMMUNITY DEVELOPMENT DIRECTOR

6.1.K. - Page 2
