Improvements include new recycled water and storm services, levee improvements, a <br />new bay trail including the path and landscaping, new sidewalk, and pedestrian lighting. <br />The levee structure will be dedicated to the City as part of the Improvement Agreement, <br />and the Landscape Maintenance Agreement will require the Bay Trail pathway and <br />landscaping to be maintained by the property owner. The project will also require a <br />revocable encroachment permit to allow for a private water main and sewer service <br />across Oracle Parkway, which will be required prior to final acceptance of the project by <br />City Council. The private services were allowed simply due the isolated parcel not <br />having nearby public facilities to construct to in a feasible manner, and a deed <br />restriction will be recorded against the property to ensure that future sale or of the <br />property will require a public system to be constructed. <br /> <br />The developer, Centrum Owners Association, and Oracle America, Inc, will post bonds <br />in the amount of $2,190,387.00 as required by the Improvement Agreement. The <br />developer anticipates completion of all improvements before school operations <br />commence.. All work associated with this project is being paid for by the developer. <br /> <br />ALTERNATIVES <br />Council may choose not to approve the parcel map and associated agreements for the <br />project. <br /> <br />FISCAL IMPACT <br />There is no fiscal impact to the City as a result of this action. <br /> <br />ENVIRONMENTAL REVIEW <br />The Planning Commission considered and certified the Environmental Impact Report <br />prepared by the City’s Planning Department in accordance with the requirements of the <br />California Environmental Quality Act (CEQA), and based on the approved <br />Environmental Impact Report and a Mitigation Monitoring and Reporting Program in <br />compliance with all CEQA requirements, as part of the City’s consideration of Planned <br />Development Permit Amendment (PDA2015-01), Use Permit (UP2015-13), <br />Architectural Permit (AP2015-63) and Tentative Map (TM2015-04). <br /> <br /> <br />JAMES O’CONNELL, PE <br />ASSOCIATE ENGINEER <br /> <br />AARON AKNIN, AICP <br />COMMUNITY DEVELOPMENT DIRECTOR <br /> <br />6.1.K. - Page 2
