ATTY/AGR/2016.160/CENTRUM OWNERS ASSOCIATION-STMMA <br />REV: 06-22-16 JS <br />Page 2 of 9 <br />the School Site Portion of the Property as well as portions of the Adjacent Property, and this <br />Agreement is being recorded against the entirety of the Property and the Adjacent Property, all as <br />described on Exhibit “A-4”, attached hereto and incorporated by this reference as if fully set forth <br />herein, in recognition of such requirement; and <br />D. Attached hereto as Exhibit “B”, and incorporated herein by this reference, is a <br />legible reduced-scale copy of the site plan showing the stormwater treatment measures that are to <br />be located or to be constructed on the School Site Portion of the Property (with a portion thereof <br />also being located on the Adjacent Property), hereinafter referred to as the “Site Plan”; and <br />E. Attached hereto as Exhibit “C” and incorporated herein by this reference, is an <br />“Inspection and Maintenance Checklist” which describes the Property Owner’s maintenance <br />activities to be performed pursuant to this Agreement; and <br />F. The City is the permittee public agency with jurisdiction over the Property (and the <br />Adjacent Property); and <br />G. The Property Owner recognizes that the stormwater treatment measure(s) more <br />particularly described and shown on Site Plan, of which full-scale plans and any amendments <br />thereto are on file with the Engineering & Transportation Services of the City of Redwood City <br />must be installed and maintained as indicated in this Agreement and as required by the NPDES <br />Permit or other regulatory agencies having jurisdiction; and <br />H. The City and Property Owner agree that the health, safety and welfare of the <br />citizens of the City require that the stormwater treatment measure(s) detailed in the Site Plan be <br />constructed and maintained on the School Site Portion of the Property (and the Adjacent Property, <br />to the extent located thereon); and <br />I. The City’s Stormwater Management Ordinance, Stormwater related guidelines, <br />criteria and other written directions (“City Stormwater Regulations”) require that the stormwater <br />treatment measure(s), as shown on the approved Site Plan, be constructed and maintained by the <br />Property Owner. <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the benefit received by the Property Owner as a <br />result of the City’s approval of the Site Plan, the Property Owner hereby covenants and agrees <br />with the City as follows: <br />1. Construction of Treatment Measures. The on-site stormwater treatment measure(s) <br />shown on the Site Plan shall be constructed by the Property Owner in strict accordance with the <br />approved plans and specifications identified for the School Site Portion of the Property (and the <br />Adjacent Property, to the extent applicable) and any other requirements thereto which have been <br />approved by the City in conformance with City Stormwater Regulations. With respect to the <br />stormwater treatment measures to be located on the School Site Portion of the Property, prior to <br />the conveyance of the School Site Portion of the Property to OAI, COA and OAI shall be jointly <br />and severally liable for the performance of the duties and obligations of the Property Owner <br />hereunder with respect to such stormwater treatment measures, and following such conveyance <br />6.1.K. - Page 56
