Determination: The determination of the appropriate user <br />category for particular premises shall be made by City’s Director <br />based upon the waste or wastewater constituents or <br />characteristics of such user, including such factors as <br />biochemical oxygen demand, suspended solids, and volume, <br />consistent with the categories hereinabove in subdivision b <br />established. The user category for any particular premises may <br />be revised, changed, or redesignated by Authority’s Manager with <br />the consent of City’s Director upon a determination by them that <br />the waste or wastewater characteristics of the user of such <br />premises have changed in such manner, or to such an extent, as <br />to justify such reclassification. Any user, permittee, applicant, or <br />other person aggrieved by a determination of City’s Director <br />made pursuant hereto may appeal such determination to <br />Authority’s Commission in accordance with the provisions of <br />Section 27.130, et seq.; provided that references in said Section <br />to “Authority’s Manager” shall be deemed to mean “Director.” <br /> <br /> <br /> <br /> <br />6.4.B. - Page 8
