REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />June 27, 2016 <br /> <br />SUBJECT <br />Second reading for Art in Public Places Ordinance <br /> <br />RECOMMENDATION <br />1. Waive the Second Reading and Adopt the Art in Public Places Ordinance <br />2. Adopt a Resolution Establishing City Policy to Include Public Art Task Force <br />review of Public Art <br /> <br />BACKGROUND <br />On June 13, 2016, the City Council introduced and unanimously approved an <br />Ordinance adding Section 2.38 to the Redwood City Code to establish the “Art in Public <br />Places Fund” and adding Chapter 45 of the Redwood City Code to (1) establish <br />regulations and procedures for provision of Art in Public Places; (2) establish a City <br />contribution of one percent of the City’s Annual Outlay Fund to be placed in the Art in <br />Public Places Fund for provision of Art in Public Places; and (3) require Commercial <br />Development projects over 50,000 square feet to contribute on-site art that is equal in <br />value to at least one percent of the project’s construction valuation or, alternatively, pay <br />an equivalent in-lieu fee, which will be deposited in the Art in Public Places Fund. Prior <br />to introducing the Ordinance, the City Council noted that it wanted to assure that the <br />City’s Public Art Task Force was involved in reviewing and making recommendations to <br />the Civic Cultural Commission. Staff has prepared a Resolution which effectuates the <br />Council’s desire to include the Public Art Task Force in reviewing any proposed Public <br />Art. <br /> <br />ANALYSIS <br />The Art in Public Places Ordinance establishes the following: the “Art in Public Places <br />Fund”; regulations and procedures for Art in Public Places; City contribution from the <br />Capital Outlay Fund to the Art in Public Places Fund; and require developers of certain <br />commercial projects to provide art on-site or pay an in-lieu fee. The details of the <br />ordinance are more fully described in the June 13, 2016 City Council staff report <br />(Attachment 1). The Final Ordinance for adoption is attached to this staff report as <br />Attachment 2. <br /> <br />Under the Ordinance the City’s Civic Cultural Commission is tasked with reviewing <br />public art projects proposed by the City and by developers and making <br />recommendations to the final decision-maker for such projects.
