<br /> 3. ��-P'YRQ and CLI�ENT shall each camply witt�applicable federal, state and local lavvs and
<br /> regulatic�ns and emptay safety progr�ms anc� rneasures cansistent wzth recagnized applicable indvstzy
<br /> standards and gractices. At alt times before and during the Praduction, it sha11 be within P'YRO`s sole
<br /> discretion to determine whether or no�the Production may be safely discharged ar eontinued. It shall not
<br /> eonstitute a breach of this Agreement by PYRU far PYRO ta deternvne that the Production cannat be
<br /> discharged or continued as a result af any canditions or circumstances at�ecti�ng safety beyand the
<br /> reasanable cantrol of FYRO.
<br /> 4. �;�j;,�-CLTENT shall ptovide aclequate secucity persannel,barricades,and Police Departrnent
<br /> services as may be necessary to preclude individuals ather than those authorized by PYRO from entering an
<br /> area to be designated by PYRO as the area for thc sc#up and discharge o�the P'raduction, includin�a
<br /> £allout area satisfactory to PYRC)where the pyratechnics rnay safely rise and at�y debris may safely€all.
<br /> PYRO sha11 k�ave no responsibility£or monitoring or controlling CLTENT's ather eontractors,praviders
<br /> ar volunteers; the pr�btic; areas to which ti�e public r�r can�raetars have access; or any other pubiic or
<br /> cnntractor fa�iIiti�s ass�iated with the Produetion.
<br /> S. [ ��n,��-PYRC) shall be respansible for the removal of all equiprnent provided by PYR4 and
<br /> clean up of any live pyratechnic debris made necessary by PXR�. CLTENT shali be respansible for
<br /> any oiher clean up which may be required of the Fraductian or set-ug, dis�harge and faltout areas
<br /> inclnding any environmen�al clean-up.
<br /> 6. �y�, - FYRf) agrees to agply for perrnits for the firing of pyratechnics only from the
<br /> _ Redwood Cily Fire Department,FAA,and USCG,if required.CLiEN'I'shall be responsible for obtaining
<br /> at�y other ne�essary }�ermits, payi�g associat�d fees, and making other appropriate arran�ement� far
<br /> Police I?epartrnents, ott�er Fire Departrnents, road closures, ever►t/activity or land use p�rn�its or any
<br /> permission or permit required by any Local,Itegionat,State or Federal Gavernment.
<br /> 7. 1,;�,l;��;�-PYR4 sk�all at all tirnes during the perfot�ance of services het�in ensure that the
<br /> fall�rwing insurance is tnaintained in cannection with PYRO's perfornnan�e of this Agreement: {I�
<br /> cornmercial genera.l liability insurance, including groduct�, completed aperations, and eontractual
<br /> liabiliry under this Agreement; (2} automobile Iiability ins�rance, (3} workers' €ompensation insurance
<br /> and emplc�yer liability insur�nce. Such insurance is to prat�ct Ci;IENT from claims far badily injury,
<br /> inctuding death, personal znjury, ar�d frorn claims of property datn�gea which may arise from P"YRC?'s
<br /> perfarr�nce of this Agr�ement, only. The types and amounts af covara�� shall be as set forth in the
<br /> Scape of Wark. Such insuranee sha11 not include claims which arise fram CT.IENT's negiiger�cc or
<br /> vs+illfuI conduct or from failure of CLIENT to perform its abligatians under this Agreement,coverage for
<br /> which shalt be provided by CLTENT.
<br /> The coverage of these policies sha11 be suhject �o reasonable inspection by CLIENT. Certificates of
<br /> Insurance evidencing the required general liability coverage shall be furnished to CLIENT prior to the
<br /> rendering of serviaes l�ereunder and shall include that the following are named as additianally insured:
<br /> GLIENT, Port of R�dwood Gitys POTI.Sft�P. IlIY�StOCS� �nd their afficers, afficial�, employees, agents and
<br /> vatunteers, Spansors,Landowners,Barg�Owners,if any; and Pernaitting Autharities,with r�spect to the
<br /> operations of PYRO at the 1�"roductian. Pyrotechnic subcor�tractors or providers,if any,not covered under
<br /> policies af insurance required hereby, shall secure, tnaintain and pxovide their own insurance coveaage
<br /> with respect t�tl�eir respective operations and services.
