McCarthy, 3509 Glenwood <br />Avenue, Mrs Ruhl, 600 Block Upton Street, Bob Chambers, 3622_Glenwood Avenue, Danny Silva, 3517 Glenwood <br />Avenue, I.Irs. Harris, owner of property in Emerald Lake, all spdke on the question. There was a very lengthy <br />t <br />discussion with the majority of the people speaking against Glen*q od Avenue and Canyon Road being included <br />rr'"" in the assessment district. Councilman Spillers moved that the pbuic hearing be closed, seconded by <br />Councilman Granger and carried. <br />Councilman Spillers offered Resolution of public convenience and necess#y and moved its adoption, seconded <br />by Councilman :ranger. This was followed by discussion as to what effect phis Resolution would have on the <br />assessment district, whether or not it would overrule all protests, whether r not the petition which was <br />presented and read protesF,ing the inclusionof Glenwood and Canyon Road would c ry over to the next and all <br />succeeding public hearings ot,be overruled by adoption of this resolution. The ty Attorney stated that <br />67th vote was required to pa E�\this resolution. The motion lost on roll call with Councilman Stout and <br />vleiss voting No and Councilman Br:>tschgi being noted absent. y <br />The City Attorney stated that there 'rere two steps which the Council could decide upon.'\,The Council could <br />,go through with the proceedings of the`Pept Limitation Art which would increase the overa cost of the <br />assessment proceedings or they could stark all over again with another Resolution of Preliminary Determina— <br />tion* Councilman Spillers spoke on subject'tnd stated that he was of the opinion that the Cou�cil should <br />l <br />1 <br />call for the bids and then if the bids were not,\what they wanted then the Council could possibly pay a <br />s re of the cost and proceed with the project. phis was followed by discussion as to what the nex Council <br />act* n would be. Councilman Stout explained why h�\voted no and he also stated his feelings on this'lqatter. <br />Councilan Herkner objected to the City paying for pro eedings and then not having the project go throuIkh. <br />He wanted'\to know approximately how much this project has'\cost the City at the present time. City Engine&r <br />fir.. <br />Jain stated\\that the cost is approximately $15,000. <br />City Attorney Currie again explained what proceedings the Courieil could take. He said the Council could <br />request a new resolution amending the plans and eliminate the area in question. This was followed by <br />discussion after whih Councilman Stout moved that the City Enginee)r amend the plans and specifications <br />to eliminate this area`\in question, seconded by Councilman 7Teiss. Councilman Herkner wanted to know what <br />the effect of the elimination of this area would have on the whole proje%th <br />Fire Chief Lodi_ was of the <br />opinion that the City shoull�,contact the Fire Underwriters and show them maps and have the,r recommend— <br />ation on this before the Councll takes official action. Councilman Herkner m%anto <br />mendment to the motion <br />to await the decision of the Fire Underwriters as'suggested by the Fire Chiefhave a study meeting <br />to discuss this matter further, sec ded by Councilman Granger who wanted a se and not a survey. <br />Councilman Spillers wanted to know if 't would be possible to have an answer in one w�ek.
