147 <br />City Attorney .Currie stated that this jtould require bids and also the insurance must be considered. <br />Councilman Weiss moved that this be referred to the City Manager for a complete report and recommendation, <br />seconded by Councilman Herkner and carried. <br />REQUEST P;:;RIMIT T,0 CONDUCT PARTNERSHIP LIQUIDATION SALE, GOLD AND GLUSKIN. The :Clerk read the letter and reported <br />that everything was in order as required by the ordinance. The City Attorney stated that he had talked to <br />FOR the attorney for Gold and Gluskin and this is a legitimate operation, one of the three partners was leaving <br />6W the .firm and they are going to hold the sale to raise the cash to by out his interest. The b siness will <br />continue. This was followed by discussion after which Councilman 1,7eiss moved that they be authorized to <br />hold the sale provided that the sword liquidation be eliminated from their advertising. City Attorney Currie <br />ruled that if this motion carried the City should refund the money and Gold and Gluskin can conduct this <br />the same as a regular sale. This was followed by discussion after which the motion lost for lack of a <br />second. <br />Councilman Weiss moved to grant the sale and in lieu of the word "liguidation" the. term "disillusion of <br />partnership" be used. This motion lost for lack of a second. <br />Councilman Granger moved to take the recommendation of the City Attorney and allow the sale, seconded by <br />Councilman Herkner. The Council did not look favorable on the word liquidation in regard to this sale. <br />The motion carried with Councilman Weiss voting No on the basis that liquidation does not give the public <br />the true picture of this sale. <br />RESOLUTION TO APPOINT A CLERK PRO -TEM DURTNG THE ABSENCE OF THE CITY CLERK Councilman Granger offered RESOLUTION <br />2031 APPOINTING THE ASSESSOR -AUDITOR AS CLERK PRO -TEM DURING T( -T CITY CLERK'S 1956 VACATION and moved its <br />adoption, seconded by Councilman Stout and carried on roll call, Councilmen Britschgi and Spillers being <br />noted absent. <br />REDVTOOD PLAY CENTER R.EGARDTNG POSSIBLE USE OF VETERATIS BUILDING, "IARREN AND STANDISH, FOR NURSERY SCHOOL. The <br />Clerk read the letter which tras followed by discussion. Councilman Granger moved that the City Council <br />looks favorably on the use of the building at the time of the request, and, since this is sponsored by the <br />Sequoia Adult School, the Council feels that the school should participate in the share of the cost, and <br />that the building will be made available at the time requested and will not effect any other use of the <br />building, and in the evening the building will be made available for use by the Boy Schouts, subject to <br />permission and approval of the proper Department Heads that the building is safe, seconded by Councilman <br />Stout. This was followed by discussion in regard to notifying the Park and Recreation Commission of the <br />Councils action and whether or not their approval should be requested. Also under discussion was the subject <br />of whose jurisdiction this building falls under. The motion carried. Councilman jTeiss asked to obstain <br />from voting on this until he had more information. This brought up the discussion as to the legality of <br />abstaining from voting. The City Attorney read the following section from the Charter:. <br />,..�, Section 15. Legislation: All members present at any meeting must vote unless disqualified, <br />in which case the disqualification shall be publ-�_cly declared and a record thereof made. <br />Councilman !`.eiss stated that he stood corrected and asked for a roll call vote. The motion carried on roll <br />call vote, Councilmen Britschgi and Spillers being noted absent. <br />Councilman Stout moved that this matter be referred to the Park and Recreation Commission, seconded by <br />.., Councilman Granger. This was followed by discussion as to why this communication should be written. <br />bow Councilman Herkner stated they are just referring this letter for their information only. Councilman Stout <br />stated that this was not so, it was for their recommendation. The motion lost on roll call with Councilmen <br />Granger and Herkner and Mayor Royer voting NO and Councilmen Britschgi and Spillers being noted absent. <br />Councilman Herkner moved that this information be given to the Park and Recreation Gommission, seconded by <br />Councilman Granger and carried. <br />COUNCILDDIN STOUT REPORT ON ANNEXATION AND SUBDIVISION CHARGES.
