0 <br />8 <br />M <br />237 <br />This appeal serves to focus attention on this type of procedure. I consider the matter of <br />sufficient import and believe it merits a thorough exploration and determination with a <br />view to the establishment of a definite policy that will apply not only to the instant <br />case, but equally to all cases of a similar nature. I feel that we should take this matter <br />under advisement, -give it a thorough examination at a study mtieeting. <br />Councilman Weiss moved that this matter be carried on the agenda until such time, say one month, as_they <br />can establish a uniform policy applicable to this and future cases, seconded by Councilman Stout. This <br />was followed by a lengtby discussion which was almost a repeat of the previous discussion in regard to <br />set back lines, and dedication of 101 strip for future street widening. The motion lost on roll call with <br />Councilmen Granger, Herkner, SpillQrs and Mayor Royer voting NO. <br />Councilman Granger moved that the minutes of this topic be referred to the Planning Commission so that <br />they might study and bring in a recommendation toward the establishment of a policy so that the Council may <br />have something to go by on this and all similar matters, seconded by Councilman Herkner. Councilman Weiss <br />stated that he did not see that the Planning Commission should set the policy for the Council to follow, if <br />arything, it should be the other way around. The Mayor said that the Planning Commission was not being <br />asked to set a policy, but they were merely asked to make a recommendation on policy matters. The motion <br />carried. <br />Councilman Granger moved to carry this an the agenda for 30 days, seconded by Councilman Britschgi and <br />carried. <br />PUBLIC HEARING, BID urLwiauj MANZANITA-LAUREL-HILTON continued from earlier in the evening. Engineer Moen <br />reported that the low bidder was Douglass and Woodhouse with a bid of $29,481.39. Councilman Herkner <br />offered RESOLUTION 2071 AWARDING THE CONTRACT TO DOUGLASS AND WOODHOUSE FOR IMPROVEMENTS TO MANZANITA- <br />LAUREL-HILTON STREETS and moved its adoption, seconded by Councilman Stout and carried an roll. call. <br />Councilman Britsohgi moved that the Clerk return deposits, if any, to the unsuccessful bidders, seconded <br />by Councilman Weiss and carried. <br />PUBLIC HEARING, HILLTOP DRIVE IMPROVE.ENTS, continuted from earlier in the evening. Affidavit of publication, <br />mailing and posting was ordered filed* The Clerk read a letter of protests from Robert A. Webber, Lot 49 <br />Carmelita Manor, wherein he stated that if said improvements are made to Hilltop Drive, without first tak- <br />ing care of the run-off waters from Eaton Avenue, his house will be setting in a lake if the b ad floods of <br />last winter and several winters prior to that are repeated. We Webber also stated in his letter that some <br />of the residents along Hilltop Drive enjoy the rural atmosphere and should they be forced to accept the <br />51 sidewalks they will no longer have a rural setting. <br />Mrs. Gwendolyn Fitzpatrick (112 Hilltop Drive) protested this action on the basis of previous assessment <br />for street improvements in 1939. She further stated in her letter that the City itself surfaced this <br />street and a ssessed the property owners for it# with the understanding that the City would maintain it. <br />The Mayor asked that Engineer Moen answer the questions as they came up in the letters. Mr. Moen stated <br />that the engineers have considered all these problems and have tried to establish a grade to fit the exist- <br />ing yard as close as possible. Mr. Webber stated that he was against sidewalks in this area and he did <br />not believe that this street was going to do his drainage any good and will probably do away with his <br />natural drainage. The question of sewage stopping up and backing up into the home of Mr. Carlisle was <br />discussed. <br />The mayor asked Mr. Moen to check into this matter. <br />streets were improved. <br />Mr. Carlisle wanted this problem settled before the <br />The Clerk read a letter from Mrs. Ruth E. Sawyer, 102 Hilltop Drive, wherein she stated that she protested <br />the plans for the elaborate street improvement of Hilltop Drive between Eaton Avenue and Alameda de las <br />Pulgas. She feels that assessment for the street would be much greater than the increase in the value of <br />her property. Mrs. Sawyer further stated in her letter that she agress that some improvement could and <br />should be made on the Alameda de las Pulgas end of Hilltop Drive.
