4- What, if any, action is proper for this council to pursue under the law <br />to remedy the situation? <br />I confess, I am at a loss to understand the situation; therefor I request that <br />the Honorable Mayor instruct the City Manager, City Attorney and appropriate <br />Department Heads to examine the records and prepare and submit by, say, August 27th <br />a comprehensive and detailed report on the questions before raised, as well as - <br />any points relevant to the questions. The report should also include any and all <br />instructions or authorizations, together with source and capacity of official involved <br />in the issuance thereof and which resulted in the apparent violations of the <br />intent and application of the ordinance to this subdiviisinn. <br />It may not be amiss to also include recommendations for actions that would <br />remedy this situation and obviate its recurrence in the future. <br />This was followed by discussion. City Attorney Currie stated that no crime has been committed in regard <br />to the subdivision ordinance, and he asked that it be made a part of the record that nothing illegal has <br />been done. Councilman Granger moved that the Clerk submit a copy of Councilman Weiss's statement to the <br />people in question, seconded by Councilman Spillers. Councilman Stout stated that there had not been any <br />accusations and, in his opinion, Councilman Weiss was only asking for information. He could not see why <br />this should be turned over to Oddstad Homes. This was followed by discussion with regard to 20 water meter <br />connections. The Mayor announced that a meeting would be held tomorrow at 2 p. m. with Oddstad Homes. <br />Mater Superintendent Winter stated that his letter was written at the request of Councilman Herkner <br />because Oddstad Homes was under the impression that everything was in order and he could not see why the <br />water connections were not allowed. This was followed by further discussion. Councilman Herkner amended <br />the motion providing that Councilman Weiss's letter be handed to the people tomorrow. Councilman Spillers <br />stated that he had withdrawn his second to the motion. Councilman Herkner withdrew his amendment to the <br />motion. Councilman Granger stated that he did not 'care if the letter was handed or made available to Mr. <br />Oddstad at the meeting tomorrow. The motion was seconded by Councilman Britschgi. Councilman Stout <br />stated that he did not believe that this was in line. The motion carried on roll call with Councilmen <br />Stout and Weiss voting N0. Councilman Weiss stated that he would be glad to furnish a copy of his letter <br />to Mr. Oddstad. <br />Councilman Spillers moved that the meeting be adjourned, seconded by Councilman Granger. The motion lost <br />on roll call with Councilmen Herkner, Stout, Weiss and Mayor Royer'voiing NO. <br />Councilman Britschgi referred to the sales tax report from 4 member of the Council. He wanted to add more <br />suggestion to the report. His thinking is that they could possibly save a good deal of money by having the <br />County handle assessing and tax collecting. This could result in changing a few offices in the City Hall, <br />releaving some of the duties of the Assessor—Auditor, City Collector and City Clerk. The Clerk could be <br />relieved of part of his work thus being able to devote more time as Clerk of the Council. He suggested <br />a meeting of the Department Heads and the City Attorney in an attempt to gather further information. <br />Councilman Granger spoke on the question which was then followed by discussion. Councilman Britschgi moved <br />to refer this to the City Manager, City Collector and City Auditor, seconded by Councilman Spillers and <br />carried. <br />Councilman Stout spoke about an article in the paper in regard to the State allowing bids to be advertised for <br />our area. Councilman Stout moved that the City Clerk contact the Highway Department in reference to this <br />article in the paper in regard to'letting the bids in the southern part of the freeway. City Engineer Jain <br />stated that this was being delayed because of the property acquisitions. Councilman Herkner seconded the <br />motion because they were by—passing Redwood City and going furher south. Councilman Britschgi stated that <br />he attended the same meeting that Cdr. Jain attended and he did not believe that the City would be getting <br />further information other -than that stated by Mr. Jain. The motion carried. <br />Councilman Stout presented the Council with a report that he had prepared in regard to annexation and subdivision <br />fees. This subject will be taken up at the study meeting Wednesday, August 15th. <br />Councilman Herkner moved to ask the City Manager for a report as to just what has happened to the 5 Points <br />overpass since its inception and he wanted to know what the cost of this improvement would be and if this <br />
