285 <br />wants they can rule on this letter beeause it is the Planning Commission's finding of the facts. This <br />was followed by discussion with regard to the action of the Planning Commission. Councilman Weiss made a <br />substitute motion toar efer this matter to the City.Attorney for a report back next week. The question that <br />the City Attorney is to rule on is if this conforms with the City ordinance and the ordinance requirements. <br />This was followed by discussion. Councilman Weiss withdrew his substitute motion and let his original <br />motion stand. This was again followed by discussion after which Councilman Granger withdrew his second. <br />The motion was declared out of order for lack of a second. <br />Councilman Stout moved approval of the Planning Commission recommendation the City Attorney to draw up the <br />necessary resolutionp seconded by Councilman Britschgi and carried.9 Councilman Weiss voting N0. City <br />Attorney Costello stated that the forms will be changed for setting variances and the Planning Commission <br />will prepare the form. <br />PLANNING COIrlMSION APPROVAL M. TESOLINI VARIANCE TO ALLOT' 10' REAR YARD INSTEAD Cr 15' (ALDEN AND ALLERTON)p <br />LOT 11 BLOCK'Ds MEZESVILLE# R-4 DISTRICT. The duplex to be constructed will replace two old buildings <br />which have been razed. This parcel is adjacent to a C-1 Zoning and the reduced rear yard will not be <br />detrimental to any adjoining property. The plans are for a garage in the rear of the dwelling rather than <br />under a two story stMctures and the additional footage is necessary. It is also a corner lot which <br />requires special consideration. Councilman Britschgi moved approval of the Planning Commission's recome- <br />endation, Seconded by Councilman Herkner and acrried. <br />Mayor Royer asked Councilman Granger to take over the meeting for the rest of the night. Councilman Stout <br />moved that the Council wish the best of luc to the two Councilmen who would be playing in the softball <br />tournament tomorrow night. This died for lack of a second. Mayor Royer left the meeting at 9=50 P. M. <br />PERSONAL APPEARANCE: Mr. Ralph Elliott asked to speak in reference to the drainage from Farm Hills. The <br />neighbors are not safisfied,with the drainage from the sumps of Farm Hills. He asked that a Committees <br />consisting of the Council and someone from the Engineering Department, meet with the property owners. <br />City Engineer Jain stated that he did not believe that a Committee seeting was necessary. The City has <br />other conditions similar to this inother parts of the City and he feels that this is -all right as is. <br />Acting Mayor Granger asked that this bs placed on the agenda and the Council to go out and look the situation <br />over. `The property is on Parkdale Way and Foothill. . <br />Councilman Stout reported that a letter had been submitted to each of the Councilmen for their consideration <br />and study. The lease has not been signed by the School Board and the Attorney has suggested that they hold <br />up the awarding of the bid until the 1"se is signed. The School Board will meet next week and they will <br />sign the lease at that time. He asked that they place this matter on the agenda for two weeks. Councilman <br />Stout moved to delay the whole matter for two weeks and the letter be made a part of the minutes* seconded <br />by Councilman Herkner and carried. <br />Councilman Herkner said that deficit fainancing was needed and he moved that the matter be referred.to <br />the City Manager to report back in one week as to his thinking and recommendation tothe deficit financing <br />seconded by Councilman Britschgi and carried. <br />PLANNING CO)aMSION RECOWIENDED APPROVAL JOHN D. TEHANEY VARIANCE TO ALLOK 5' SIDE YARD SET BACK CORNER LOTS. <br />When this property was subdivided the City requested an additional street (Sierra) be dedicated and <br />improved# which made the two corner lots five feet below the usual standards. The original plan did not <br />show this street and it was felt that the entire subdivision need not be redesigned for this right-of-way. <br />The requested 5' setback will,not be detrimental to the adjoining P. G. & E. Substation property. Council- <br />man Britschgi moved approval of the Planning Commission's recommendation. This was followed by discussion <br />in regard to the 10' and the 5' that were written on the map. Councilman Britschgi suggested that the <br />Council hold this matter over for one week and look at the other plans for sierra Street. The property <br />
