8 2 <br />.Councilman Granger moved that the City Attorney give some consideration to the freight shed, seconded by <br />Councilman Spillers. This was followed by discussion after which the motion carried. <br />CITY MANAGER REPORT REGARDING REVIEW OF PERMIT TO BLIND INDUSTRIES SALES CO. The original permit was granted <br />September 41 1956, and the Council had asked that this matter be reviewed in 60 days. The City Manager <br />reported that he checked with the Police Department and the Chamber of Commerce and they have no received <br />any complaints. The Police Department has issued a few permits. <br />The Mayor announced that the Council was not going to hear -the matterof the samll boats at the Yacht Harbor. The <br />paper was in error that it would be heard tonight as the matter was not placed on the agenda. <br />Councilman Stout asked about the emergency ordinance and wanted to know why it wasn't on the agenda. The City <br />Attorney stated that he would have it ready in about two weeks. There was no set time as to when this <br />item was supposed to be placed on the agenda as Councilman Stout thought. The City Attorney had been asked <br />to check into the matter and came back with a new ordinance. <br />Councilman Spillers offered ORDINANCE 834 APPROPRIATING $17,530 FROM THE CAPITAL PROJECT FUND FOR THE PURPOSE <br />OF CONSTRUCTING AND EQUIPPING POLICE BUILDING AND AUTHORIZING THE -CITY MANAGER TO EXPEND SAID SUM FOR SAID <br />PURPOSE and moved its adoption, seconded by Councilman Granger who asked that the ordinance be read by the <br />Clerk. The Mayor -asked the Clerk to read the ordinance in brief. The City Manager stated that it is under- <br />stood that this estimate is the best figure that they have today. The motion carried on roll call with <br />Councilman Britschgi being noted absent. <br />ACCEPTANCE AND FINAL ESTIMATE RELIER SEW UNIT VIII. The City Engineer recommended that this project be <br />accepted subject to the following requirements as specified in the contract documents and specifications for <br />this project on Page CD -13-A: <br />1. Two year guarantee of workmanship and materials. <br />2. Posting of a two-year maintenance bond in the amount of $21053.12 (15% or contract amount) to <br />guarantee the repair, reconstruction and resurfacing of any part of the <br />pipe trench, backfill, and/or <br />surfacing which may fail within two years from date of acceptance of the project. This bond shall in no <br />way release the contractor from any obligations guaranteed by the bonds referred to in the agreement, namely <br />Faithful Performance and Labor and Material Bonds, <br />Councilman Stout moved acceptance according tothe recommedation, seconded by Councilman Herkner. Councilman <br />Spillers asked why they required two years. Mr. Jain stated that this was a part of the contract and was <br />the usual procedure for this type of work. The motion -carried. <br />ELMER H. IVIS, 351 ST. FRANCIS STREET, APPEAL FOR EXTENSION OF TIME FOR CONSTRUCTION CF SIDEWALK. Mr. Ivie asked <br />for an extension of one year because he recently suffered a heart attack and will be unable to work for <br />approximately six months. The only income he has is his disability insurance and he has a family of four <br />to live on this amount. Councilman Spillers, under the conditions that the man is ill and because of the <br />possible weather conditions, moved that they allow a six months extension, seconded by Councilman Granger. <br />Mr. Jain stated that this is in the area that does not have any sidewalks and is also the area that the <br />Council asked to be fixed. This was followed by discussion. Councilman Granger withdrew his second to the <br />motion and he suggested that a committee go out and talk to the man and possibly his doctor and see if he <br />can pay monthly installments. The motion was seconded by Councilman Weiss. This was again followed by <br />F"" discussion after which the motion carried on roll call with Councilmen Granger and Herkner voting NO and <br />L <br />Councilman Britschgi being noted absent. <br />The Mayor asked Councilman Granger to go out and talk to the man and follow through on his thinking as <br />previously stated. <br />REQUEST FOR SEGREGATION AND AN APPORTIONMENT OF DIAGRAM ASSESSMENT NO. 81 RESOLUTION NO. 1780, INDUSTRIAL WAY. <br />The Clerk mad the letter. Councilman Spillers moved to refer'this to Attornies Currie, Lebsack & Hannig <br />for a repirt back in two weeks, seconded by Councilman Weiss and carried. <br />
