Mr. Currie stated that the Council should determine its <br />intention in regard to the commencement of the lease term. The use permit was granted on April 30th, <br />and they didn't start operations until July 1st. Councilman Granger seconded Councilman Weiss't, <br />motion. This was followed by discussion. Counc-tLnan Spillers stated th•>t he would go along with this <br />motion if they will have the Cinnabar Committee work with the City Manager on this report. This was <br />not included in the motion. The motion carried with Councilman Spillers voting NO. <br />Councilman Herkner moved that the lease be prepared and executed in accordance with the adiertisement <br />for bids and the original offers of Oddstad for a term of one year commencing July 1, 1956, without <br />extension, seconded by Councilman Spillers. This was followed by discussion after whichthe motion <br />carried on roll call with Councilmen Stout and Weiss voting NO. <br />councilman weiss regarding deferred items requiring council consideration. Councilman Weiss read a list <br />of 18 items which he believes deserve Council attention. These items had been included on the <br />agendas or had been brought to the Council's attention at prior meetings. Councilman Granger moved <br />that this statement be referred to the City Manager to be placed as item number one on the January <br />7th meeting, seconded by Councilman Herkner. This was followed by discussion after which the motion <br />carried on roll call. <br />Councilman Britschgi offered RESOLUTION 2158 APPROVING SAN MATEO COUNTY DRAFT MASTER PLAN RELATIVE TO <br />WATERWAYS AND SMALL CRAFT HARBOR LOCATIONS and moved its adoption, seconded by Councilman Spillers <br />and carried on roll call. <br />NQS. THOMAS JONES CLAIM FOR ALLEGED INJURIES, FALL AT FRIENDLY ACRES BRANCH LIBRARY. Councilman Stout <br />moved that the claim be denied and referred to the insurance carrier, seconded by Councilman Spillers <br />and carried. <br />Items 14 and 15 on the agenda (approving progress payments to Oscar Holmes) would be skipped as they were <br />insluded in the claims. <br />15 REQUESTS FOR EXTENSION OF TIME, SIDEWALK REPAIR NOTICES. Casci. <br />Councilman Granger moved that these be referred to the Committee for a report back at the first <br />meeting in January, seconded by Councilman Herkner and carried. <br />COMMUNICATION FROM LESTER BROWN REGARDING PLANNING COMMISSION AGAIN DENYING USE PERMIT AT 532 WINSLOW AND <br />510 ALLERTON STREETS. In his letter, Mr. Brown stated that he made a new application deleting any <br />reference to any contemplated remodeling at the above address, said application being simple for a <br />use permit. This re-application was heard before the Planning Corunission on December 11, 1956, and <br />was turned down. The Clerk read the above mentioned letter and also the joint letter submitted at <br />a previous Council meeting by the Building Inspector and the Fire Chief. The City Attorney asked <br />that 6ection 502 of the Unioform Building Code, 1952 Edition, be made a part of the minutes. Section <br />502 reads as follows: <br />No change shall be made in the character of occupancy or use of any building which would <br />place the building in a different Group of occupancy, unless such building is made to <br />comply with the requirements of this Code for the Group. <br />EXCEPTION: The character of the occupancy of existing buildings may be changed subject <br />to the approval of the Building Official, and the building may be occupied for purposes <br />in other Groups without conforming to all the requirements of this Code for those Groups, <br />,.)rovided the new or proposed use is less hazardous, based on life and fire risk, than the <br />existing use. <br />No change in the character of occupancy of a building shall be made without a Certificate <br />0 <br />W <br />L] <br />
