Councilman Britschgi moved that this matter be returned to the Planning Commission for further consideration and asked that the people in the area be notified, seconded by Councilman Spillers. City Attorney asked that this be continued on the agenda and still refer the matter to the Planning Commission and ask them to report back to the Council. Councilman Britschgi amended his motion to carry this on the Council agenda until March 19th and still notify the Planning Commission to reconsider the matter, seconded by Councilman -Spillers and carried. 09 PUBLIC HEARING, PLANNING C014MISSION DENIAL DALE STUART APPLICATI(N TO REZONE LOT 7, BLOCK F, WOODSIDE ACRES soma (1630 Union) FROM R-2 to R-3. Affidavit of mailing was ordered filed. There'were no written protests. Mr..Dale Stuart spoke in favor of the rezoning as forming a buffer zone and he referred to the January 10th minutes of the Planning Commission as a possible enlightment on the situation. There is over 37P000 square feet to the property in question. This was followed by discussion in regard to the present zoning in the area. Councilman Britschgi moved close of public hearing, seconded by Councilman Royer and carried. Councilman Britschgi moved to overrule the Planning Commission's recommendation for denial and approve the application, the City Attorney to prepare ordinance to rezone, seconded by Councilman Spillers. This was followed by discussion as to why the Planning Commission voted rezoning. Motion carried on roll call. PUBLIC HEARING, PLANNING COT,11ISSION DENIAL OF M. CANCLINI APPLICATION TO REZONE PORTIONS OF LOTS 8 & 10, BLOCK G, WOODSIDE ACRES (1584 Gordon) FROM R-2 TO R-3. Affidavit of mailing was ordered filed. There were no written protests. Mr. Canclini, son of the owner, stated that their property was 1051 x 2751 and all they wanted was permission to build another home on their property. His parents live in the present house and wants to build a home on the back. They will deed to the City a 27, strip for any furture street which might divide the property in case of a street between Union and Gordon. Councilman Royer asked the City Attorney if there was any way in which the Council could grant permission for the second home without rezoning, possibly by granting a variance. City Attorney Currie stated that they could not grant a variance in this case, however, they could sign a Declaration of Restrictions. Councilman Royer moved close of public hearing, seconded by Councilman Spillers and carried. Councilman Royer moved that the property be rezoned to R-3 with the understanding that the City Attorney prepare a Deed of Restrictions restricting the property avners to building of two homes, seconded by Councilman Britschgi and carried. PETITION WITH APPROXIMATELY 600 NAMES WAS TURNED IN REQUESTING TRAFFIC SIGNALS AT HUDSON AND WOODSIDE ROAD. The Clerk read the petition. Councilman Stout asked if the Traffic Fact Finding Committee had made a any studies in regard to this matter. Chief Faulstich stated that this was done about two or three years ago. Councilman Spillers moved that this be turned over to the Traffic Fact Finding Committee for consideration and to notify the State and ask permission to erect some. City Attorney Currie stated ! that the Council should state just what portion they are willing to bear before notifying the State. wow Motion seconded by Councilman Royer and carried. INTRODUCE ORDINANCE REGARDING SUBDIVISION OF LESS THAN FIVE LOTS. Councilman Britschgi was of the opinion that the Council should hold up on this until after the study meeting. City Attorney stated that this wasn't necessary as this was an amendment to the subdivision or dinance relative to subdivision of less how than 5 lots. This was followed by discussion after which Councilman Stout offered introduction of ordinance, seconded by Councilman Spillers and carried on roll call. The public hearing will be set for February 6th. RESOLUTION TRANSFERRING $$2,000 FROM UNBUDGETED RESERVE TO COVER COST OF INSTALLING TRAFFIC SIGNAL AT JEFFERSON AND HUDSON STREET.
