This was followed by a lengthy discussion by the Council and members of the audience. This motion lost on <br />roll call with Councilmen Granger, Jones-, Stout and Mayor Herkner voting No. Councilman Royer refrained <br />from voting. <br />Councilman Jones moved that the use permit be granted with the 201 'set back required, seconded by Council— <br />man Stout. This was followed by discussion. The motion carried on roll call with Councilmen Britschgi <br />and Spillers voting No. Councilman Royer refrained from voting. <br />Councilman Granger moved to refer this matter back to the Planning Commission to work out a solution to ...r <br />the matter, seconded by Councilman Jones. Councilman Stout wanted to know what was being referred back <br />to the Planning Commission. Was it the plan lines? Councilman Granger stated that setting the plan <br />lines was not up before the Council tonight and he believes that this should be turned back to the Plan— <br />ning Commission. This was followed by discussion. Councilman Britschgi wanted to know if the plan lines <br />..rw <br />were turned down would the Council be willing to cancel the 201 set back which was required by the grant— <br />ing of the Use Permit tonight. This was followed by discussion after which Councilman Stout again asked <br />Councilman Granger to clarify his motion as to what he wants referred back to the Planning Commission. <br />Councilman Granger stated that since this is going to be set for a public hearing on February 28th the <br />Planning Commission should check back into this matter. The motion carried on roll call with Councilmen <br />britschgi and Spillers voting No. <br />City Attorney Currie stated that the Council should take some action on the variance. The clerk read <br />the letter from the Planning Commission wherein they recommended approval of the application of Max <br />Livchitz for a variance to extend R-4 use into rear 100 feet of lot now in R-3 District (2610 E1 Camino <br />Real), R-4 and R-3 District, subject to obsrvance of proposed plan lines for the extension of Carlos Avenue. <br />Councilman Granger offered RESOLUTION 1976 FOR A VARIANCE TO ALLOW EXTENSION OF R-4 USE INTO REAR 100 <br />FEET OF LOT NOW IN R-3 DISTRICT SUBJECT TO OBSERVANCE OF PROPOSED PLAN LINES FOR THE EXTENSION OF CARLOS <br />AVENUE and moved its adoption, seconded by Councilman Stout. Councilman Britschgi spoke of all the <br />driveways which would be opening onto E1 Camino Real if this is granted. This was followed by further <br />discussion. City Attorney stated that the Council was not granting the plan lines they were merely being <br />asked to set the property back in the event of any proposed plan lines. The motion carried with Council— <br />men Britschgi and Spillers voting NO. Mr. Aaronson asked the City Attorney to write him a letter in <br />regard tow ho would be required to pay for the extension of Carlos Avenue. City Attorney Currie reported <br />that he could not write the letter at this time. He explained that there were no plan lines for Carlos <br />Avenue at the present and until such time that these plan lines are adopted he could not say who would <br />pay for the street. This was followed by discussion. <br />PERSONAL APPEARANCE, ALYN BEALS, PARK AND RECREATION C OP:RTISSIONER. Mr. Beals spoke to the Council and stated <br />that he was appearing before the Council as a member of the Park and Recreation Commission. He stated <br />that they needed new facilities in Community Park. They need adequate space and they need dressing <br />rooms and other facilities, craft rooms and meeting rooms. They need concessionary machines and indoor <br />recreation rooms. These are all general budget items and usually they would wait until budget time <br />febore bringing this matter before the Council, however, the San Francisco 49ers have asked for certain <br />facilities for which they will pay for over a period of time. He explained that the time they would use <br />such facilities would not interfere with the activities of the park. They would use the building <br />approximately 30 days during the 90 days they would sign up for the building. <br />The City gets particularly needed facilities for this and they get a home for the 49ers, the facilities <br />to be paid for over a period of time. He explained the many advantages the City would derive from this <br />move and also the publicity which would come to the City as being the training center for the 49ers. <br />Mr. Beals introduced Mr. Louis G. Spadia, general manager of the 49ers, and Mr. Frank Albert, head coach. <br />Red Morton, Recreation Director, stated that the field the 49ers would be using for practice will be <br />D <br />own <br />
