35 <br />lines for a service road paralleling Woodside Road from Valota Road to Massachusetts Avenue. This was <br />followed by discussion on the advisability of waiting for the Planning Commission's decision and also in <br />regard to the parking lots designated on the Shopping Center map. City Attorney Currie stated that it was <br />his opinion that there was a Declaration of Restrictions which would take care of the parking situation in <br />that area. <br />Councilman Granger brought up the question of the people in the area petitioning the Council for a service <br />road. Mr. Wagstaff stated that he did not believe that the people in the area would Rant the service roast <br />unless the area was rezoned commercial. After a lengthy discussion, Councilman Granger was of the opinion <br />that the Council defer this for one week and wait for the decision.of the Planning Commission in regard to <br />the plan lines. Councilman Stout moved that the public hearing be continued for one week, seconded by <br />Councilman Royer and carried. <br />6 <br />PERSONAL APPEARANCE, RALPH CYR PRESENTED PETITION TO THE COUNCIL ASKING FOR FULL IMPROVEMENTS IN THE AREA AROUND <br />KENTFIELD, PALM, GORDON, OXFORD, KANSAS AND UNION STREETS. Mr. Cyr stated that they had been circulating <br />petitions,in this area for about one year. These was approximately 65% of the signatures of the property <br />owners on Kentfield and Palm Avenues signed to the petition, however, they had not been able to secure the <br />necessary 51% of the signatures to start proceedings for the -whole area. Mr. Cyr explained that the people <br />who did not sign the petition stated that the water drained off their property and were not interested in <br />a storm drainage system. Mr. John Burggraf stated that there were 48 signatures to the petition. It was <br />explained that the water from these other streets emptied and flooded Kentfield.. Palm and Oxford streets. <br />The City Attorney explained to the Council that it it was the Council's wish they could proceed in the same <br />manner as in Friendly Acres Improvement District, and if it becomes necessary to overrule a majority protest <br />it would require a 4/5th vote of the Council or 6 out of 7 Councilmen would have to vote to overrule the <br />protests. <br />City Engineer Jain stated that he was in favor of the improvements but urifurtunately the 65% is on two <br />streets and it isn't fair to the prople on these two streets to take car of the whole area which will be the <br />case in this section. This was followed by a lengthy discussion. <br />Councilman Britschgi moved that the City Engineer be instructed to start plan's and specifications for the <br />area involved, the area being between Hudson and Valota Road and Woodside Road and Redwood Avenue, City <br />Engineer Jain stated that the area should be from Hudson Street to Virginia Avenue and Redwood Avenue to <br />Woodside Road. Councilman Britschgi amended his motion to include Virginia Avenue, seconded by Councilman <br />Jones, Councilman Jones question whether or not this was broad enough to include any addition to water <br />mains and improvements. City Attorney Currie stated that the City Engineer would include all the improve - <br />vents which are necessary. City Engineer Jain stated that this was a large project and it is too big for <br />his department to handle -at the present time, however, they would start the project immediately and get it <br />out as soon as possible. They might have to hire outside engineers to com;ete the job. Councilman Britschgi <br />asked to include in his motion that the City Engineer should farm out any work that he deems necessary. <br />Councilman Royer wanted to know if anyone had any idea as to what the percentage of property owners of the <br />entire area had signed the petitions. He was of the opinion that the City Engineer should check the percent- <br />age, and, if it is only 10%, then perhaps they should be checked before entering into the project. Council- <br />man Royer asked that maker of the motion to indicate if he would accept the amendment to hold over for one <br />week and the City Engineer to inspect the <br />petitions and report back next week. Councilman Britschgi was of <br />the opinion that this should not be hold up waiting for people who live out of town to make up their minds <br />in regard to signing the petitions because in the meantime the people living in the area are troubled with <br />water. He feels that they are just going to have to take the "bull by the horns" and proceed with the <br />project. Councilman Stout concurred in the statement made by Councilman Britschgi but he agreed with <br />Councilman Royer and asked that this be hold up for one week to have the names checked.
