4'7 8 <br /> understood. The motion carried. <br /> City Engineer Jain spoke in regard to calling for bids for the resurfacing of city streets. Councilman <br /> Stout offered RESOLUTION 2242 APPROVING SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BODS FOR <br /> RESURFACING OF STREETS and moved its adoption, seconded by Councilman Spillers and carried on roll <br /> call, Councilman Granger being noted absent. <br /> Councilman Herkner asked for a report on the water reservoir. The City Attorney stated that he was of <br /> the opinion that the City could call for bids. The plans and specifications have been approved for "" <br /> the reservoir. Mr. Jain stated that the engineer who is working on the project, W. Brian, has not <br /> completed the specifications on the pipe line. There seems to be some trouble with the engineer <br /> getting the work set out to the satisfaction of our engineering department. The specifications are .ong <br /> being corrected now. Councilman Weiss moved that the matter be referred to the City Manager to get <br /> the work done as soon as possible, seconded by Coun ilman Herkner and carried. <br /> Mr. Jain reported that there is still one piece of property that they tried to get for the right- <br /> of-way. They expect to get the deed in the next week or so. <br /> Councilman Stout suggested that the Council take into consideration during budget time the problem of <br /> getting more personnel for the Engineering Department. Councilman Herkner called attention to the <br /> balance in the Engineering Salary Account and that the Council was not at fault for the personnel <br /> situation. <br /> Claims 22461 through 22614, totaling $46,835.15, were ordered paid on motion of Councilman Spillers, <br /> seconded by Councilman Herkner. Councilman Weiss raided the question if all the bids were in order <br /> with the appropriations. He was assured that this was correct. Councilman Weiss asked if there were <br /> any refunds for water consumption with the claims. Auditor Brophy advised that there were none. The <br /> motion carried. <br /> Councilman Weiss read a statement wherein he said that he had received several calls asking various <br /> questions relative to the Water Department Indebtedness and its propriety that has been the subject <br /> of discussion the last two meetings. It appears that some people are preturbed by this Council's <br /> attitude which indicates its unwillingness to have the question legally determined, especially as <br /> eviddnced by Councilman Granger's statement at our last meeting "let a taxpayer bring a taxpayers <br /> suit and spend his own money." He reiterated once more his belief and conviction that this question <br /> of over a quarter million dollars water deal has implications that warrants exploration. Councilman <br /> Weiss moved that the entire matter and related questions be referred to the City Attorney for ex- <br /> ploration, determination of legal questions and problems involved, and that he submit his opinion <br /> as to the validity of any and all matters involving the Carson-Monckton-Land Development water deal <br /> with the City, and in the event the press of other matters and current work in his department is of <br /> such volume as would prevent his giving this matter reasonably diligent and expeditious attention, <br /> he submit suitable recommendation of toher means of approach to the problem and as will permit an <br /> LNIS' <br /> early and proper determination and action to resolve this question once and for all. This motion <br /> lost for lack of a second. <br /> Councilman Spillers moved that the meeting be adjourned to May 27th at the hour of 8.OQ P- L, seconded by <br /> 711 .
