The motion carried. <br /> Councilman Herkner offered RESOLUTION 2243 FINDING AND DETERMINING THAT PROTEST TO THE PROPOSED <br /> ANNEXATION TO THE .CITY OF REDWOOD CITY OF CERTAIN UNINHABITED TERRITORY DESIGNATED FARM HILL ADDTTION <br /> NO. 1 HAS NOT BEEN MADE BY OWNERS OF ONE-HALF OF THE VALUE OF SUCH TERRITORY AS SHONN BY THE LAST <br /> EQUALIZED ASSESSMENT ROLL, NOR ,BY PUBLIC AND PRIVATE OWNERS EQUAL TO ONE-HALF OF THE VALUE OF SUCH amid <br /> TERRITORY AS DETERMINED BY SAID _COUNCIL and moved its adoption, seconded by Councilman Granger and <br /> carried on roll call, Councilman Weiss voting No and Councilman Spillers being noted absent. <br /> Councilman lierkner offered RESOLUTION 2244 AUTHORIZING AGREEMENT BETWEEN CITY OF REDWOOD CITY AND <br /> ODDSTAD HOMES IN CONNECTION WITH ANNEXATION OF CERTAIN TERRITORY TO CITY OF REDWOOD CITY DESIGNATED <br /> ftwi <br /> FARM HILL ADDITION NO. 1 and moved its adoption, seconded by Councilman Weymouth. Councilman Weiss <br /> read a prepared statement which reads in part as follows: "Postponement of payment of the annexation <br /> fee would be a bad preceddnt and can many times in the future cause this Council considerable embarrass- <br /> ment....We must not overlook or forget that this type of indebtedness....cannot be made a lien against <br /> the property and I do not believe that payment at a later date could be enforced even in the event of <br /> default....The Council cannot or should not enter into any agreement or take -any action that could <br /> result in the loss of specific revenues to the City....the result of such action would be that for all <br /> purposes and intents we would be loaning the City's money to private corporations or individuals for <br /> their personal benefit and gain. I certainly believe that such action would be highly irregular, if <br /> not illegal, and certainly I cannot be a party to any such agreement." The City Attorney stated that <br /> this was not illegal. Councilman Weiss asked if this indebtedness could be enforced as a lien against <br /> the property. The City Attorney stated it was not a lien against the property. Councilman Weiss <br /> A <br /> asked what their rights were to enforce the indebtedness at a later date. The City Attorney stated <br /> that as he had previously informed the Council there is some question about the enforcability of the <br /> agreement but stated that as a practical matter the Council had practical control of the situation <br /> since it governs the filing of subdivision,=maps in the .area. Councilman Stout spoke on the subject <br /> and stated that since other cities had an annexation fee ordinance that he believed that the City <br /> could also have one. He was of the opinion that this could be establishinga precedent. This was <br /> followed by discussion. The Mayor stated that the Council did not agree to waive the annexation fee. <br /> This was followed by discussion. The annexation fee will be paid before the map is recorded. The <br /> motion carried on roll call with Councilman Weiss voting No and Councilman Spillers being noted absent. <br /> Councilman Weymouth offered introduction of an ordinance of the City of Redwood City approving the <br /> annexation to the City of Redwood City of certain uninhabited territory designated "Farm Hill Addition <br /> No. 1" and herein described, aid herein annexing said territory to said City of Redwood City, seconded <br /> by Councilman Stout and carried, Councilman Weiss voting NO. <br /> CITY MANAGER REPORT AND RECOMMENDATION ON ST. VINCENT DE PAUL REQUEST FOR EXEMPT LICENSE TO OPERATE THRIFT <br /> SHOP. The Clerk read the letter from the City Manager in which he stated that he checked with the City <br /> Collector and has been informed that similar organizations are now operating under our local business .. <br /> ordinance with no apparent hardhsip or complaint. In fairness to these two organizations, and in <br /> order to be consistent, it would seem difficult to make an exception in this particular. case. The <br /> City Manager recommended that they charge the license fee and require the necessary bond. Councilman <br /> Weymouth stated that he only raised the question of the required bond.
