Councilman Stout moved that this item be taken up at <br /> the budget study meeting, seconded by Councilman Weiss. Councilman Granger stated <br /> that he did not think this was a budget study issue. He thought this could be taken <br /> up at a regular study meeting. Mr. Jain stated that they would probably have the plans <br /> ml <br /> completed within the next couple of weeks on the first phase. The Recreation <br /> 4 <br /> Commission has not seen the plans as yet. This was followed by discussion in regard <br /> to whether or not this should be considered at a budget study meeting. Councilman Stout moved that the letter be field, seconded ..rd <br /> by Councilman Granger and carried. <br /> PETITION REGARDING WATER DEPkiTMry T INDEBTEDNESS. The Clerk read the petition, 15 signatures, <br /> which reads in part as follows : <br /> ". . . .Therefore, we the undersigned citizens and electors of Redwood City petition your <br /> honorable body to take action at the earliest possible date as would cause a complete <br /> and factual legal determination to be made of all actions pertaining to and involving <br /> such indebtedness for, by and on behalf of the Redwood City Water Department and the <br /> City of any and all transactions, agreements, etc. leading thereto. Further, that a <br /> complete resume of all matters pertaining thereto and final determination of their <br /> legality and propriety be made public through the press as soon as practicable. " <br /> Councilman Weiss moved that the entire matter and related questions affecting the Water <br /> Department indebtedness which is the subject of this petition be referred to the City <br /> Attorney for exploration, determination of legal questions and problems involved, and <br /> that he submit his opinion as to the validity of any and all matters involving the <br /> Carson-Monckton, Land Development and other water deals with the City, and in the event <br /> the press of other matters or current work in his department is of such volume as would <br /> prevent his giving this matter reasonably diligent and expenditious attention, he sub- <br /> mit suitable recommendation of other means of approach to the problem and as will per- <br /> mit an early and proper determination and action to resolve this question once and for <br /> all, seconded by Councilman Stout. Councilman Granger stated that he did not think <br /> that t h statement the t tement is true that the City is indebted to the sum of X300,000 as stated <br /> by Councilman Weiss. Councilman Weiss differed with Councilman Granger in the fact <br /> that he believes that this is an indebtedness to the City. Councilman Stout stated <br /> that he wanted to reiterate his previous statement that he seconded this motion so it <br /> will clear up the matter once and for all. ihis was followed by discussion after which <br /> the motion lost on roll call vote with Councilmen Granger, Herkner, Spillers , Weymouth <br /> and Mayor Royer voting NO. <br /> wird <br /> Councilman Herkner moved that the City Manager come in with a written report to the <br /> Council and to the Press giving a full statement as to the reason for the agreement <br /> with the several companies and the action taken by the Council and the fact that it <br /> was approved by legal council at the time and the compromise was to the benefit to <br /> the City, seconded by Councilman Spillers. Councilman Weiss stated that this matter <br /> was brought up because of the previous report made by the City..Manager and he did not <br /> believe that the City Manager was the proper authority to make the report. The motion <br /> carried with Councilman Weiss voting NO. <br /> The City Attorney requested that some action be taken in regard to securing the necessary <br /> property for completions of deeds for the water reservoir and also deeds for Emerald <br /> Lake project.
