<br /> CITY MANAGER REPORT ON WATER DEPARTMIIVT INDI�'B�ID�JESS,. The Mayor asked the Clerk to read
<br /> the first page of the report whieh reads as follows:
<br /> At a regular ad�ourned meeting held on June 10, 1957, this office was '
<br /> �irected by the City Council to reaetivate a previous report on the ,
<br /> above sub�ect, which was orig3nally submitted on April 4, 1957•
<br /> �..�. The Council also requested that a copg of the Court�s decision con- ,
<br /> r= cerning an agreement entered between the City and the Land Development '
<br /> � Company under date of April 12, 195�, be included in this report. How- '
<br /> e ver, since the City Clerk�s files contain a copy of this agreement,
<br /> but do not appear to contain a copy of the Courtts action, I am refer- ,
<br /> ring this matter to the City Attorney on the assumption that he is ',
<br /> better prepared to advise the Council on this legal matter. '�
<br /> While the "propriety" of making refunds is a matter of �udgement in which
<br /> �.., there may be an honest differenae of opinion, depending upon the cir-
<br /> cumstances in each individual case, I am quite sure that all agreements
<br /> � entered into by the City Council for water refunds, were made upon the
<br /> advice of the City �ttorney, after a careful check by the Water Depart- '
<br /> ment as to the amounts involved in each ease. '
<br /> However, in an attempt to comply with the Council� a directions, I have
<br /> instrueted the Water Superintendent to prepare a resume of the City
<br /> Clerk�s �files covering a period of several years, concerning trans- �
<br /> actions relating to water refunds in the Redwood Terrace, Westwood i
<br /> Terrace, S erling Highlands and Sterling Heights area�, �ahich a re the
<br /> ma,�or loca�ions in question. I
