Chester Lebsach <br /> spoke in favor of adopting the zoning ordinance and putting into efect R-3-G zoning. Councilman �eiss read the <br /> follororing prepared statementz <br /> Just as the land use plan is of vital importance to theaomaminity� so the zo�aing ordinance is a vital question. <br /> The proposed amendments cover sorae pertinent points and I am somexhat c�ncerned abaut the pravisions o�f some <br /> the changes proposed. lccordingly I offer the follairing co�nts for the consideratian of the Couneil: <br /> ' Re par. 1� pages 1 & 2 - A nsw paragraph numbered 15.1 (d) is proposed to be added regulating aet baeks under <br /> certain conditions. It appears thatit is essentiai that some sort ""'�' <br /> of standards vrhich must be met such as character of design� e tc. is in canfar�mity with the general atmosphere <br /> of the neighborhood should be specified. <br /> �e par. 5� pages 5� 6 & 7. - Sub sec. (h) 2 would permit serv:ice stations in the newly established C-N zoness. <br /> Personal7,y I believe they are objectional�le in such areas and not necessarily essential in purely neighbor- <br /> r.00d shopping areas� and should be eliminated from this section. As f or heigh limitations porvided by sub <br /> sec. (c)� r�y remarks on simil.ar provisions in R-3-G areas are equally applicable in this case and the same <br /> actic� is reco�ended. In sub see. (e) 1 - the �rords "partiallyn should be struck end the �rorc3s "$d�jacent <br /> tow substituted. Sub sec. (g) cavers Architectural Control. �y remarks on the same subject previously made <br /> in connection with ft-3-G zoning are here applicable equally. <br /> Par. 10� page 11 - Sec. 20.l� whieh deals with sariances. To me this is a very import,ant funetion and con- <br /> siderable authority is being delegated� it is therefor �y feeling that we must be careful to praperly pro- <br /> tect the interests of all the people and avoid arrogating eactreme poqrers to the Baard of Ad3ustments in the <br /> exercise of the ri.ght to impose conditione in the granting oF variances. I therefc�r offer the f ollc�ing: . <br /> After the words «general xelfaren ther� shauld be inserted the words - "pravided that no conditions requir- <br /> ing the dedication of ar�r la,nds or other property without proper coanpensation shall be imposed." I offer <br /> said proposal in all sincereity and I eall the attention of all concerned to the fact that the Constitution <br /> of the United States specifically provides" � nor be deprived of life, liberty� or property� �without c1�e ° <br /> process of lawi nor shall private property be taken for public use� �ri.thaut 3ust compensation."
