Councilman Herkner o.ffered ftESOLUTION 2317 BEING A RESOLUTION OF <br /> INTENTION TO MaDIFY AND �MEND PROCEEDIPIGS UNDER RESOI�IITION OF INTEt�TION N0. 2255, FARM HILL ,BQULEVARD <br /> . <br /> IMPROVF�;�NTS and moved its adoptian� seconded by Counci.lman Spillers and carried on roll call. <br /> VICTOR ROBELET� 1It59 �ENER STRF.ET� REQUEST PERMISSION TO INSTALL A DRIVF�fAY TO APARTI+�NT HOIISE. The Clerk <br /> read the letter wherein Mr. Robelet stated that his aFartment house is completed and rented. He ca.nriot use <br /> one of the garages because he has no approach to it from the street. Councilman S pillers moved to grant <br /> application of Victor Robel.et for exception to the provisions of Section 5(b) of Ordinance 639 because of <br /> practical diff.iculties and unnecessary hardships to permit construction of dri.veway approach as sho�rt on <br /> the plat included in the application: sec rnded by Councilman Granger. This �►as followed by discussion. <br /> Councilman �Yeiss spoke on the question and stated that he was of the opir�ion that there wasn�t any hard— <br /> ship 3n this particular case. Councilman Spillers explainec! the situation to the Council. Crnancilman <br /> �eiss asked for the recorr�^iendation of the City Ilzgineer and the City Manager. The City Engineer stated <br /> that �his was a matter of policy and he asked that he not make a recommendatian. The City M.anager stated , <br /> that he was not fami.liar �rith this matter. Councilman Pdeiss moved that the matter be tabled until the <br /> City &lanager makes a report. This motion lost for lack of a second and the original motion c arried on,roll <br /> ca1.1 �ith Councilman Staut and Meiss voting No. <br /> Councilman Spillers braught up the matter of the mo�ion made by Councilman Weiss at the meeting of Sept— <br /> ember 16th with regard to wri��sn approval. of the City T�anager bef ore givi.ng items to t he press. <br /> Councilman Herkner stated that he would second this moticm beca.use he did not fully understand tP.e <br /> motion made by Councilm�azi Weiss possibly due to the lateness af the hour. Councilman Weiss read a <br /> � prepared statement which is an file in the office of the Cit,y Clerk, On a point of order� Couneil— <br /> �,,, r�an �Yeiss was allowed tc� conti rnze with his statement if he would leave aut personalties. This was <br /> followed by discussion. Councilman Herkner stated that the only part af the motion that, Co,ancilman <br /> V!leiss made at f.he last meeti��� that h� did not approve was the matt�r of havi.ng the City Man�ger rp— <br /> p�-rt �o the Crnzncil before allawrin� the matter to �o to the pre9s. It was his awn fault that he did ' <br /> not catch that part of the motion �rhen he seconded it.
