403 <br /> Councilman Weiss stated that there were two meetings scheduled for Wednesday night, two study meetings and a <br /> meeting of the National Association Power Engineers. Since Councilman Stout was an engineer, Councilman <br /> Weiss suggested that he be excused from the study meeting and allowed to attend the Engineer's meeting. <br /> Councilman Stout agreed to attend the meeting. • <br /> Councilman Spillers moved that all the rest of the items on the agenda be carried on the agenda for next week, <br /> lims1seconded by Councilman Weiss and carried. <br /> Councilman Stout moved that the meeting be adjourned to February 25th at the hour of 8:00 P.M. seconded by <br /> Councilman Spillers and carried. M. <br /> INVOCATION was led by Reverend Ralph Benson, Pastor North Fair-Oaks Community Church. <br /> ON ROLL CALL the following were noted present: Councilmen Floyd D. Granger, Sidney D. Herkner, Robert V. Spillers, . <br /> Hiram S. Stout, Louis Weiss, Ray Weymouth, Mayor William H. Royer and City Clerk R. S. Dodge. Also present <br /> were City Manager E. A. Rolison, City Engineer Glenn M. Jain, City Attorney Robert Costello, Water <br /> Superintendent H. L. Winter, Police Chief William Faulstich, Police. Captain Theodore Moudakas, Building <br /> Inspector S. H. Kreiss, Fire Chief J. L. Lodi, Fire Marshal George Asvos, Park and Recreation Commissioner <br /> Hanley, Planning Commissioner Carl Sjoberg and Account-Clerk Vivian Holmquist. <br /> COURTESY DRIVER OF THE WEEK AWARD was awarded by James Harms, Junior Chamber of Commerce representative, to <br /> Glenn Lovelace, 290 Grand Street. <br /> CITY MANAGER ON DISPOSITION OF ANNEXATION FEES. The Clerk read the report which read in part as follows; <br /> Section 82 of the Charter, governing disposition of public moneys, provides in part as <br /> follows: nAll city officials - - empowered to collect money for fees - - or other municipal <br /> charges, shall collect the same - - turn them into the city treasury daily - - and report <br /> the same to the city auditor weekly. Al such money - - shall be credited to the General <br /> Fund of the city, and shall be applicable to any purpose to which the Council may <br /> appropriate them . . .n <br /> Therefore, in my opinion, it is the intent of the Charter that:all fees, which would <br /> include annexation fees, should be handled in the above manner. <br /> Councilman Weiss read a prepared statement which is on file in the City Clerk's office. In his statement, <br /> Councilnan Weiss stated_that it was his belief that, in all discussions leading to the adoption of an <br /> annexation fees, it was tacitly understood that receipts therefrom were intended to reimburse the city for <br /> its investments in Capital Projects and that they would be applied to the same purpose, that is, their <br /> expansion and improvement as demanded by our continuted growth and the demand of the increasing population. <br /> Councilman Weiss moved that the City Attorney be requested to prepare and submit for study and ordinance <br /> that will clearly set forth the intent and the procedure to the effect that the Council shall appropriate <br /> annually to the Capital Projects Fund, an amount equal to receipts from annexa -:tions fees, seconded by <br /> Councilman Stout. Councilman Granger wanted to be sure that the motion wasn't in conflict with the Charter. <br /> He was informed that this was not in conflict. Councilman Stout spoke on the question and stated his <br /> reasons for seconding the motion. The motion.carried unanimously on roll call. <br /> L.. SIDEWALK COMMITTEE RECOMMENDATION reads as follows: <br /> The Council appointed Sidewalk Committee met February 20 to consider requests for <br /> extension of time on sidewalk notices issured by the City Engineer's office, and the <br /> committee wishes to make the following recommendations: <br /> NOTICE NOTICE WORK O NERS'S NAME COMMITTEE <br /> NUMBER DATE LOCATION AND ADDRESS RECOMMENDATION <br /> 186 & 187 12/11/56 Lots 17 & 18, Ryan & Harper, Ind.
