4 9 <br /> PLANNING COMMISSION RECOMMENDED DENIAL OF VARIANCE TO ALLOW 5'-REAR YARD SET BACK AT 427 SAMSON STREET, <br /> F. E. RUSSELL REQUEST, (Lot 9, Block 10, Range D., Mezesville). The Clerk read the letter from the <br /> Planning Commission. The Mayor ordered the letter filed. <br /> CITY ENGINEER REGARDING AMENDED ASSESSMENT #2, INDUSTRIAL WAY ]MPROVEMENTS. The Clerk read the letter from the <br /> City Engineer wherein he gave the figures on the segragation and reapportionment of the above mentioned <br /> assessment. The City Engineer spoke about the cost involved in regard to splitting the assessment. This <br /> was followed by discussion. The Mayor suggested that the City Engineer, in the future, ask the applicant <br /> to furnish the descriptions for the necessary splits. Councilman Stout moved to set the matter for public <br /> hearing, seconded by Councilman Spillers and carried. <br /> MASSARIE REQUEST PERT TO BUILD DUPLEXES ON LOTS 5 TO 8, BLOCK 4, WEST REDWOOD (corner Roosevelt and Valota <br /> Road). The Mayor outlined the history of this particular case. This was first brought to the attention <br /> of the Council in October, 1955. It was the recommendation of the Mayor and that of the City Attorney <br /> to refer this matter back to the Planning Commission. Councilman Spillers moved to refer this matter to <br /> the Planning Commission, seconded by Councilman Stout and carried. <br /> Councilman Herkner offered RESOLUTION 2191 ENDORSING ESTABLISHMENT OF A FIRE TRAINING CURRICULUM AT SAN JOSE <br /> JUNIOR COLLEGE AND SAN JOSE STATE COLLEGE and moved its adoption, seconded by Councilman Spillers. The <br /> Mayor added that this was recommended by the City Manager and the Fire Chief. The motion carried on roll <br /> call. <br /> WESTERN NEPHROSIS SOCTRTY, INC., REQUESTS PERPILSSION TO CONDUCT A FUND-RAISING DRIVE DURING THE MONTH OF MARCH <br /> for the purpose of raising funds to be used in connection with their work in combating nephrosis, a kidney <br /> desease most commonly found in young children. The methods planned are mainly contacts with the public <br /> by means of radio, television, newspapers, window-displays, sane letters, posters and billboards. Some <br /> [:: canisters will be used. There will be no door-todoor solicitation. Councilman Granger moved to refer <br /> this matter to the United Crusade for their recommendation. The City Manager stated this was not a door- <br /> to-door <br /> campaign. The Police Chief stated that he did not think there was anything the Council could do <br /> since there wasn't any violations to any ordinances. Upon the recommendation of the City Manager and the <br /> Police Chief, Councilman Spillers moved that the permit be granted without endorsement of the Council, <br /> seconded by Councilman Herkner. Councilman Weymouth asked if this would interfer with the Red Cross. <br /> It was the general opinion that since this was not a door-to-door campaign it would not interfere. The <br /> motion carried. <br /> GLENWOOD AVENUE ASSOCIATION OPPOSING IMPROEMENTS. The Clerk read the letter. Councilman Spillers moved that <br /> the Council hold a study meeting on this. He was of opion that the City should get the job done even if they <br /> only had 10% of the property owners in favor of the improvements. Councilman Spillers changed his motion <br /> to authorized the City Engineer to complete the plans for water mains so they can proceed with the calling <br /> [:: for bids, seconded by Councilman Granger. Councilman Stout stated that he did not believe they should go <br /> against the will of the people and force them to pay for installations of water mains. This was followed <br /> by discussion. Councilman Spillers outlined the previous proceedings which occurred at previous Council <br /> meetings on the improvements of the Highlands of Emerald Lake No. 1. Councilman Granger withdrew his <br /> second to the motion. <br /> [:: Councilman Spillers moved to have a study meeting, seconded by Councilman Herkner and carried. Councilman <br /> Spillers asked for the complete set of minutes in relation to this subject. <br /> CITY AUDITOR REQUEST FOR PERMISSION TO TRANSFER THE GENERAL RESERVE FUND OF $100,000.00 INTO THE GENERAL FUND. <br /> The Clerk read theletter wherein Mr. Brophy stated that it has been found that it will be necessary to <br /> use this money pending collection of the second installment of taxes. Councilman Granger offered <br /> resolution 2192 AUTHORIZING THE TRANSFER FROM THE GENERAL RESERVE FUND and moved its adoption, seconded by <br />
