312 <br />Counai_lman Granger asked that condideration be given to having new commissioners and reappointed commissioners <br />presented to the Council and given the loyalty oath. <br />Jim Carlson, 127 Camelia Street, asked that the original wording on the "no water contact" signs in the Port and <br />Harbor area be changed back to the original wording stating that the waters are polluted. Mr. Carlson was <br />asked to again speak to the City Manager as this was an administrative matter rather than a policy making one. <br />Councilman Herkner reported that the Legislative Committee is trying to get the Flood Control Bill approved as <br />amended by the City and they have contacted members of the State Legislature. <br />Claims 29376 through 29565, totaling $146,726.42, were ordered paid on motion of Councilman Rosselli, seconded <br />by Councilman Spillers and carried. <br />Councilman Spillers moved that Councilman Rosselli be Mayor pro -tem for the next week (MINUTE ORDER #59-92), sec-. <br />onded by Councilman Herkner and carried. <br />Councilman Spillers moved that the meeting be adjourned, seconded by Councilman Fields and carried. M. <br />Invocation was led by Reverend John Fast, Free Methodist Church. <br />ON ROLL CALL the following were noted present: Councilmen Ron W. Fields, Floyd D. Granger, Sidney D. Herkner, <br />Robert V. Spillers, Ray Weymouth, Mayor pro -tem John Rosselli and City Clerk R. S. Dodge. Mayor William H. <br />Royer was noted absent. Alsop resent were City Manager J. E. Neal, City Attorney Robert J. Costello, Assist- <br />ant Planning Di.recotr Leonard Knittel, Assessor -Auditor John J. Brophy, City Engineer Glenn M. Jain, Police <br />Chief William Faulstich, Building Inspector S. H. Kreiss, Fire Chief J. L. Lodi and Deputy City Clerk Vivian <br />Holmquist. <br />Assemblyman Carl A. Britschgi was recognized and seated with the Council as an "Honorary Councilman" with no <br />voting privileges. <br />PUBLIC HEARING ON THE TIDEUPATER OIL COMPANY APPEAL FROM THE BOARD OF ADJUSTMENTS DENIAL OF A USE PERP.9IT for construct- <br />ion of a service station and installation of a sign on commercially zoned property owned by the Tide Water Realty <br />Company and situated at the northwest corner of Whipple Avenue and Arguello Street, or 1319 Whipple Avenue. The <br />public hearing was declared open and the affidavit of notice was ordered filed. After the reading of the letter <br />of appeal. by the Tidewater Oil Company and the report of the Planning Commission, Councilman Granger moved that <br />the. evidence of the Planning Cormmission be made a part of the record (MINUTE ORDER #59-93), seconded by Council- <br />man <br />ouncilman Weymouth and carried. <br />"The following evidence was submitted At the Planning Commission meeting: ....i <br />1. Petition of protests signed by 8 property owners in the immediate area. <br />2. Three property owners appeared in protest. <br />3. Study of application and plans. <br />4. Review of existing land use in area. <br />Report of Action: After careful consideration of the Board of Adjustments, it was the unanimous opionion that <br />the establishment, maintenance and conducting of a service station will be detrimental to the health, comforts <br />convenience of the persons residing in the neighborhood and will be injurious to property in said neighborhood. <br />It was moved by Commissioner Bedbury, seconded by Commissioner Greenwold, based on the above, that the use <br />permit be denied. The motion passed unanimously (7 to 0)." <br />Frank Hannig, representing Tidewater Oil, addressed the Council and stated that his clients had purchased this <br />
