He based <br />his plea on the fact that Whipple Avenue has changed and is now in the form of of a major street and an <br />east -west connecting link between El Camino Real and Bayshore Highway* Adjoining property owners Al <br />Plaehn, stated that his apartment had been designed with the thought in mind that a service station or <br />a commercial building would eventually be built on tbn, property in question and as such he had no ob- <br />jection to the service station. <br />Mrs. Beatrice Reimer., 1419 Arguello Street., represented residents of 1427.,1418.914IOp. 02pl4llPI318.- <br />1227.,1219 Arguello Street$ 819 Whipple Avenue, and 134 and 132 "At, Street. She asked that consider- <br />ation be given to the residents living in the neighborhood and spoke about the traffic piling up when- <br />ever a train goes through. She also spoke of the lighting problem created by the service stations* <br />Mrs. Harry Hanson., 1219 Arguello Street., stated that it cheapened the neighborhood when there were so <br />many service stations in the area. Mr. Olaf Pearson., 1318 Arguello Streetik raised the question of <br />whether or not a repair shop would be included in the station plans as they now have in operation at the <br />corner of El Camino Real and Broadway. He also referred to the smell of gasoline when the tanks are <br />being filled by the trucks* Mrs. Mary Bartole., owner of apartment houses on Whipple Avenue and on How- <br />land Street., also objected to the granting of the use permit to allow a service station. <br />Councilman Spillers moved that the public hearing be closed., seconded by Councilman Granger and carried. <br />Councilman Fields moved to approve the action of the planning Cofmlssion and deny the use permit and <br />based his action on the fact that he had not heard any new evidence to change the findings made by the <br />Planning Commission (MINUTE ORDER #59-94)3 seconded by Councilman Herkner and carried on roll call., <br />Councilmen Fields., Granger, Herkner and Mayor pro -tem Rosselli voting yes., Councilmen Spillers and <br />Weymouth voting no and Mayor Royer being noted absent. <br />PUBLIC HEARING ON THE LOYAL ORDER OF MOOSE APPEALING FROM THE BOARD OF ADJUSTMENTS DENIAL OF A USE PERMIT <br />for the construction of a lodge upon parcel 2 of Resubdivision of Lands of Oddstad Homes and recorded <br />December 21s 1955, in Volume 2939., on Jefferson Avenue., containing 2.23 acres. The public hearing was <br />declared open and the affidavit of notice was ordered filed* After the reading of the report Of the <br />Planning Commission and the letter of protest from Irving M. Terzichs 3624 Jefferson Avenue$ Louis <br />Reed, representing the Moose Lodge$ addressed the Council* He stressed the fact that they were a <br />fraternal order, mentioned the other organizations that would plan to make use of their hall) and stated <br />that they had a Club Liquor license* Perry Bygdnesp Harold B endor and Al Plaehn all spoke in favor of <br />the granting -of the use permit* <br />Frank Sutter, 3636 Jefferson Avenuep objected to the granting of theuse permit because of the noise <br />problem. <br />Councilman Granger raised the question as to whether or not they ever planned to have anything else than <br />a club license. Councilman Herkner asked if they could handle the lodge without -a liquor license, Mr. <br />Reed stated that all the other Moose Lodges have liquor licenses And they did not feel they should be the <br />only lodge without one. They have had their Club license for about seven years, Councilman Spillers <br />moved that the public hearing be closed., seconded by Councilman Herkner and carried. <br />Councilman Granger moved to direct the City Attorney to prepare an appropriate resolution to reverse <br />the action of the Planning Commission and grant the use permit subject to the condition that the Club <br />license be the only license authorized and no broader type license be granted, seconded by Councilman <br />Spillers, Councilman Herkner moved to amend the motion to approve the request with the provision that <br />no liquor be sold* The amendment lost for lack of a second.- The original motion lost on roll call with <br />a tie vote., Councilmen Granger, Spillers and Weymouth voting yesp Councilmen Fieldsp and Herkner and <br />Mayor pro -tem Rosselli voting no and Mayor Royer being noted absent. <br />
