3 5 3 . <br />Councilman Weymouth moved that the minutes of September 25th and September 28th be approved as mailed. The <br />City Attorney asked that the minutes of September 25th be corrected to show that no new evidence was <br />received concerning the proposed permit system truck ordinance. Councilman Weymouth changed his motion <br />to approve the minutes as mailed and amended, seconded by Councilman Spillers and carried. <br />PUBLIC HEARING ON THE APPEAL OF CECIL C. DUNCAN from the Board of Adjustments denial of a variance of a set- <br />back line to 6 feet on Sierra Street for a double garage to be constructed on Lot 8, Block 12, West <br />Redwood Subdivision (1204 Sierra Street). The public hearing was declared open and the affidavit of <br />notice ordered filed. The Assis tant Planning Director gave the report of the Planning Commission. <br />After the reading of Cecil Duncants appeal, Mr. Duncan addressed the Council and stated his reasons <br />!"^' for his appeal. There were not protests. Councilman Herkner moved that the public hearing be closed, <br />seconded by Councilman Weymouth and carried. Councilman Weymouth moved to refer the matter back to <br />the Planning Commission because of the change in the original request (MINUTE ORDER #59-154), seconded <br />by Councilman Spillers and carried. <br />PUBLIC HEARING ON ANNEXATIO14 CF SEQUOIA TERRACE. The public hearing was declared open and the affidavit of <br />publication was ordered filed. The Planning Commission recommended that the Sequoia Terrace property <br />be annexed on the grounds that it lends itself by character, terrain, etc* to approximately thirty- <br />five building sites and that the necessary annotation fee be based on that number of lots. Mr. <br />Chester Tyner, 243 Upland Road, representing the Cordilleras Valley Association, read a letter wherein <br />they asked that lot sizes be in keeping with the surrounding properties, a minimum lot size of 20,000 <br />square feet was deemed advisable and proper. They also requested that a representative of their group <br />be present at future planning or study sessions and requested that they be notified as to the dates <br />and times of any such planning meetings. Councilman Spillers moved to carry this on the agenda until <br />s <br />November 2nd as requested by Mr. Shaw, representing Baird & Zion (MINUTE ORDER #59-155), seconded by <br />Gouncilman Herkner•and carried. <br />PUBLIC HEARING ON LESLIE ANNEXATION 2-B. Without any discussion, Councilman Weymouth moved to continue <br />this item on the agenda until November 2nd (MINUTE ODER #59-156), seconded by Councilman Spillers and <br />carried. <br />Councilman Weymouth moved adoption of ORDINANCE NO. 950 REPEALING ORDINANCE NO. 843, IMPOSING LOCAL SALES <br />TAX, REPEALING ORDINANCE NO. 844,IMPOSING LOCAL USE TAX; REPEALING ORDINANCE NO. 846, PORVIDING FOR <br />ALLOCATION OF SALES AND USE TAX REVENUES AND REDUCTION OF MAXIMUM GENERAL TAX RATE; REPEALING ORDINANCE <br />NO. 8522 PROVIDING FOR ELECTION PRIOR TO IMPOSITION OF LOCAL USE AND SALES TAXATION; AND, REPEALING <br />ORDINANCE NO. 889, PROVIDING FOR SUSPENSION CF ORDINANCE N0. 846 UNTIL THE IMPOSITION AND COLLECTION <br />CF LOCAL SALES AND USE TAXES, seconded by Councilman Spillers. Reuel Myers, 210 Lexington Avenue, <br />addressed the Council and referred to the petitions with 5000 signatures protesting the sales tax. <br />POO <br />Councilman Fields appeared at 8:55 p• m. <br />Paul Tessendorf also addressed the Council. After discussion, the ordinance carried on roll call with <br />Councilmen,Field.s, Herkner, Spillers and Weymouth voting yes, Mayor pro -tem Rosselli voting no and <br />Councilman Granger and Mayor Royer being noted absent. <br />Councilman Herkner moved that the City Attorney prepare an ordinance stating that before a local and/ <br />or use tax ordinance be put into effect that the matter be put to the people for an electorate vote <br />(MINUTE ORDER #59-157), seconded by Councilman Spillers and carried on roll call with Councilmen Fields, <br />Herkner, Spillers and Mayor pro -tem Rosselli voting yes, Councilman Weymouth voting no and Councilman <br />Granger and Mayor Royer being noted absent. <br />BUILDING INSPECTOR REQUESTS CONSIDERATION ON THE ADOPTION OF THE UNIFORM GAS CODE. The Clerk read the <br />ordinance. Councilman Spillers moved to set the matter for public hearing on November 2nd (MINUTE <br />
