Mr. Smith stated that the Critique is an ; �+ updated EIR prepared because of Planning Com- mission concerns about air traffic safety and � the height of the building and about ground i �r traffic. Council members,Assistant City Manager Smith and City Attorney Schricker questioned Mr. ' Smith about the material he wished to present. Mr. Schricker pointed out that the only ques- i tion before Council is the narrow one regard- ing the Planning Comnission decision that a Negative Declaration would not suffice and ! that a supplemental EIR should be prepared. Mr. Schricker said that if new material or � the merits of what would be in a supplemental i EIR are to be presented, then the matter ; would have to go back to the Planning Com- mission. 'Mr. Smith insisted his presentation was related only to the subject of the appeal. � In response to question, Mr. Smith advised that the building has been reduced from 112 feet to 98 feet because certain equipment is to be placed under the building instead � of on the roof. Inovue, Barton-Aschman Associated, � Inc., San Jose, (traffic engineering) referred to his letter of August 3 contained in the Critique relating to traffic and distributed � another letter dated August 6 to correct an ; error in the August 3 letter.
