<br /> � s City Manager Fales noted that the matter had been con-
<br /> tinued from September 23, 19?� at the request of the
<br /> applicant, and that a report had previously been sent
<br /> to Council.
<br /> Plannin� Director Schroeter briefly summarized the sequence
<br /> of events relating to the application for a variance, in
<br /> which it was requested that a fence height of four feet,
<br /> six inches be permitted whereas the Zoning Ordinance
<br /> allows three feet. Further, the request was that the
<br /> fence be permitted within the public right of way. The
<br /> Planning Commission found no evidence to support granting
<br /> the variance, and the request was denied. He advised that
<br /> the applicant and representative were present.
<br /> Florence Kins�, 202 "A" Street, indicated that, as pur-
<br /> c�aser o�'��Fie property, she was concerned that a three
<br /> foot fence would not offer enough security for her youn�
<br /> child, that there was no back yard, and so was requesting
<br /> approval to allow the fence to be four feet, six inches.
<br /> She displayed a poster she had prepared depicting com-
<br /> parative sight angles for automobile traffic in the inter-
<br /> � section for the two different heights.
<br /> �,,, The Planning Director responded to questions by Council,
<br /> advising that the maximum height allowed was three feet,
<br /> and that the fence as proposed would be in violation in
<br /> two respects. In addition to exceeding the maximwn
<br /> height permitted, the fence would also be at the sidewalk,
<br /> within the public right of way. City Manager Fales com-
<br /> mented that if Council were to �rant the variance re-
<br /> quested, it would be necessary that an encroachment
<br /> permit be issued as well.
<br /> During discussion by Council, the opinion was expressed
<br /> that the inclination would be to approve a four-foot
<br /> fence in view of concerns expressed by the applicant for
<br /> the need for security, except for the fact that it would
<br /> encroach well into the public right of way.
<br /> MOTION: Councilman Norris moved, seconded by Councilman
<br /> Williams, to affirm the decision of the Planning Commis-
<br /> sion and deny the variance with respect to fence height
<br /> requirements.
<br /> The motion carried unanimously by voice vote.
