Further, the request was that the
fence be permitted within the public right of way. The
Planning Commission found no evidence to support granting
the variance, and the request was denied. He advised that
the applicant and representative were present.
Florence Kins, 202 "A" Street, indicated that, as pur-
caser o'Fie property, she was concerned that a three
foot fence would not offer enough security for her youn
child, that there was no back yard, and so was requesting
approval to allow the fence to be four feet, six inches.
She displayed a poster she had prepared depicting com-
parative sight angles for automobile traffic in the inter-
section for the two different heights.
,,, The Planning Director responded to questions by Council,
advising that the maximum height allowed was three feet,
and that the fence as proposed would be in violation in
two respects. In addition to exceeding the maximwn
height permitted, the fence would also be at the sidewalk,
within the public right of way. City Manager Fales com-
mented that if Council were to rant the variance re-
quested, it would be necessary that an encroachment
permit be issued as well.
During discussion by Council, the opinion was expressed
that the inclination would be to approve a four-foot
fence in view of concerns expressed by the applicant for
the need for security, except for the fact that it would
encroach well into the public right of way.
MOTION: Councilman Norris moved, seconded by Councilman
Williams, to affirm the decision of the Planning Commis-
sion and deny the variance with respect to fence height
requirements.
The motion carried unanimously by voice vote.
,., (MINUTE ORDER N0. 7-189
"" Written Communications
Mayor Weymouth announced that he had received requests
from two groups to be heard earlier than the scheduled
-3-
Reg.Mtg.
10/7/74
. ..:, , .., . .
. , ..:. „ , , ,:., , ,,. ,, .,,,,,,.; , ;,
..,.
