Mr. <br /> "� Schroeter read the conclusions contained in the staff <br /> Final Environmental Impact Report, EIR 74-18 of <br /> �~°� September 17, 197�+. <br /> Harold W. Hinch, one of the owners and the proposed de- <br /> veloper of the sub�ect property, restated the contents <br /> of his Letter of Appeal of September 20, 1974. In re- <br /> sponse to question, Mr. Hinch stated he has owned his <br /> portion of the property since 19�7 and has an option on <br /> the rest of it. He stated also that he has prospective <br /> tenants for the shops he would like to develop. <br /> Discussion followed concerning the zonin� of the area; <br /> the reason rezoning of the entire block is requested; <br /> the desirability of maintaining compatible uses in the <br /> area; the heavy traffic in the neighborhood; the dif- <br /> ficulties which might result if a small shopping center <br /> were developed in the busy area; the permitted uses on <br /> the property as it is presently zoned; and the need for <br /> maintaining integrity in zoning. <br /> Mayor Weymouth invited anyone present who wished to <br /> speak to do so. <br /> !� Mrs. Kennet�h R�al�h, 319 Howland, stated that she opposes <br /> e cons ruc�n of a sma.11 shopping center because of the <br /> �,,,�, potential hazard to children in the neighborhood due to <br /> probable increase in traffic. <br /> Mrs. Margaret Gilboy, 1210 Warren, expressed concern that <br /> er ax,es m g e raised in the event of a zone change. <br /> Mrs. Barber, 280 Howland, owner and resident of an apart- <br /> ment house at that address, ob�jected to any development <br /> of the subject property which would increase the already <br /> heavy traffic. It was explained that the property owner <br /> is entitled to develop his property in accordance with <br /> the present R-5 zoning which represents high density <br /> apa.rtments, but he has requested a zone change to C-G <br /> to permit him to develop small shops instead. <br /> MOTION: Councilman Barrett moved, seconded by Council- <br /> man Henderson, to close the public hearing. <br /> The motion carried unanimously by voice vote. <br /> MOTION: Councilman Barrett mo��ed, seconded by Council- <br /> man Leipzig, tha.t with regard to property in the vicinity <br /> � of Whipple Avenue and Arguello Street that the Council <br /> finds that the requested rezoning from R-5 and R-S-T to <br /> CG is not in conformity with the General Plan; and, <br /> �""'" further, that the findings set forth in EIR7�4-18 of <br /> September 17, 197� affirm the findings of the Planning <br /> Commission; and that the City Council, therefore, up- <br /> holds the decision of the Planning Commission in denying <br /> the application for rezoning. <br /> -2- <br /> Reg.Mtg. <br /> 10/l�/7� <br />
