66 <br /> City Manager Fales called attention to the letter of December 28 , 1973 received <br /> from Robert C . Bills , attorney for the property owner . Mr . Bills had requested <br /> that consideration of the proposed zoning map amendment be continued for 120 days , <br /> Robert C . Bills , advised that the present owner of the subject property is United <br /> Artists Theatre Circuit , Inc . , successor to United California Theatres , Inc . He <br /> requested that the Council delay zoning the property back to I -P ( Industrial Park ) <br /> from C -G ( General Commercial ) . He reminded the Council that the land was zoned <br /> C -G to accommodate a K-Mart development which did not materialize for financial <br /> reasons . Mr . Bills stated that K-Mart has expressed a renewed interest in the de - <br /> velopment , and several other proposals have been suggested to the owners . He <br /> stated further that any of these might be desirable development of the site from <br /> the City ' s point of view and asked for a 120-day continuation to investigate them . <br /> Mr . Bills advised that in exchange for the continuation , the property owners would <br /> agree not to proceed with any development and would report the nature and extent of -- <br /> any proposal deemed economically feasible which would produce an attractive , high- <br /> quality asset for the City . <br /> City Attorney Schricker advised that while the offer of the property owner may be <br /> made in good faith it is not binding in law and that , in any event , the Council has <br /> the authority it needs to review proposed development of the site according to the <br /> zoning established . Mr . Schricker suggested that a continuation of 120 days would <br /> be excessive . <br /> Discussion followed and Mr . Fales , Mr , Schricker and Planning Director Schroeter <br /> replied to questions of Council members concerning the kinds of development per- <br /> mitted under the present and proposed zoning landscaping standards , and a reason- <br /> able length of time for which continuation of consideration might be granted , <br /> MOTION : Councilman Weymouth moved , seconded by Councilman Williams , to continue <br /> the public hearing to the Regular City Council meeting of March 11 , 1974 with the <br /> understanding that the public hearing will remain open and that additional public <br /> testimony may be taken at that meeting . <br /> The motion carried unanimously by voice vote . (MINUTE ORDER #74 -01 ) <br /> Appeal - denial of Application for Approval of Tentative Map , Atherwood Unit No , 2 <br /> Planning Director Schroeter reviewed the background concerning the subject develop - <br /> ment and advised that lots in the presently proposed development are now in excess <br /> of minimum standards of the zoning ordinance . <br /> ( Councilman Norris arrived at 8 : 21 p . m . ) <br /> A map of the subject area was displayed , and Mr . Schroeter replied to questions <br /> concerning details of the proposed development . <br /> Robert J . Costello , attorney for the property owner , described the present proposed <br /> development , the history concerning the annexation of the property to the City , and <br /> replied to questions from Council members , <br /> MOTION : Title having been read , Councilman Weymouth introduced the following reso- <br /> lution and moved , seconded by Councilman Rhodes , its adoption with the conditions <br /> listed below : <br /> Resolution No . 7083 Overruling Planning Commission Rejection of Application <br /> for Tentative Subdivision Map of Land and Exceptions to Certain Provisions of <br /> Chapter 30 of the Code of the City of Redwood City , Being the Subdivision <br /> Regulations of Redwood City , and Authorizing and Approving Said Exceptions <br /> and Tentative Subdivision Map (William H . Royer , John E . McCarthy and Sons , <br /> and Jules M . Eichorn) <br /> CONDITIONS : <br /> 1 ) That the street improvements , including curbs , gutters , and sidewalks , <br /> be installed on the street system to the satisfaction of the Public <br /> Works Department . <br /> 2 ) That a one -foot non-access strip be shown at the end of Atherwood Avenue . <br /> 3 ) That the location , number , and type of fire hydrants and fire alarm boxes <br /> be provided as required by the Redwood City Fire Department . <br /> 4 ) That the major trees be retained and protected as determined by the Parks <br /> and Recreation Department , <br /> 5 ) That street trees be installed at not less than one for each lot or more <br /> than 50 feet apart and be the type recommended by the Parks and Recrea - <br /> tion Department . <br /> 1/7/74 <br /> Reg .
